About this file

This is a Certificate of Compliance with 49 CFR Part 655 for the Los Angeles County Metropolitan Transportation Authority (LACMTA), addressing prevention of alcohol misuse and prohibited drug use in transit operations. The document serves as a certification form that bidders and proposers must complete to demonstrate their compliance status or commitment to compliance with federal transit safety regulations. Bidders must first determine whether the contract work will require performance of "Safety Sensitive Functions" as defined in 49 CFR Part 655. If safety-sensitive functions are not required, bidders proceed directly to signature authorization. If safety-sensitive functions are required, bidders must complete additional sections demonstrating either established or planned implementation of anti-drug use and alcohol misuse programs, as well as drug and alcohol testing programs that meet the requirements of 49 CFR Part 655.

For contracts requiring safety-sensitive functions, bidders have the option to certify that they have already established and implemented compliant programs or that they will establish and implement such programs prior to contract award. Bidders selecting the latter option must submit both their Anti-drug Use and Alcohol Misuse Program and Drug and Alcohol Testing Program to LACMTA for review and approval before receiving contract award. The certification must be signed by an authorized representative of the bidder or proposer organization, with all relevant checkboxes completed to indicate which compliance pathway the bidder is pursuing.
