About this file

This is a Certificate of Compliance with 49 CFR Part 655 document required for bidders and proposers on contracts involving the Los Angeles County Metropolitan Transportation Authority (LACMTA). The certificate establishes compliance requirements related to the prevention of alcohol misuse and prohibited drug use in transit operations. Bidders must determine whether the work required under the contract will involve "Safety Sensitive Functions" as defined in 49 CFR Part 655. If safety-sensitive functions are not required, the bidder may proceed directly to the signature section. If safety-sensitive functions are required, the bidder must complete additional compliance sections and submit required documentation prior to contract award.

For contracts involving safety-sensitive functions, bidders must certify either that they have established and implemented or will establish and implement prior to contract award an anti-drug use and alcohol misuse program meeting the requirements of 49 CFR 655, as well as a drug and alcohol testing program that complies with 49 CFR Part 655. Bidders selecting the safety-sensitive functions option must submit both their anti-drug use and alcohol misuse program and their drug and alcohol testing program to LACMTA for review and approval before contract award. The certificate requires authorization and signature by an authorized representative of the bidder/proposer with title and date.
