About this file

Summary

This is a Certificate of Compliance document addressing federal regulatory requirements under 49 CFR Part 655, which establishes protections for employees in public transportation operations. The certificate pertains to compliance obligations for state and local transit agencies receiving federal funding under the Federal Transit Administration programs. The document serves as a formal attestation that the contracting agency has implemented and maintains policies and procedures to protect transit employees' rights regarding drug and alcohol testing, as well as labor protections under federal transportation regulations. This compliance certificate is typically required as part of the procurement process for transit-related contracts and demonstrates the agency's commitment to maintaining federal standards for employee safety and protections.

The certificate requires the agency to certify that it has established a Drug and Alcohol Testing Program in compliance with 49 CFR Part 655 requirements and that all contractors and subcontractors will be bound by these same requirements. The document typically includes attestations regarding the agency's employee assistance programs, testing procedures, and adherence to confidentiality provisions. As a compliance document, this certificate carries no direct pricing implications but serves as a mandatory prerequisite for contract award, ensuring that all awarded vendors understand and accept their obligation to comply with federal drug and alcohol testing regulations applicable to safety-sensitive positions in public transportation operations.
