Questions and Answers during Advertisement for CO FLAP 209(1), Cottonwood Pass

November 9, 2016

Q1 – Bid Item 60501—000 Standard Underdrain System; Plans sheets 525-A, Note 5 specifies to supply all materials per Subsection 706.08. Per 706.08, all materials are for gaskets for Concrete Pipe. Please specify the pipe for this work.

A1 – The Note 5 should refer to Subsection 708.04 of the PF 14. It appears the Standard Drawing was not updated from the FP03.

Q2 – Special Conditions; Section 602- Culverts and Drains; 602.03 states “ Excavate and backfill according to Section 209 using lean concrete backfill”. We would like to seek clarification on:

a) Is this required for all 24 Inch diameter and 36 Inch diameter pipe culverts?

b) Should you require this, please provide the mix details, like strength and material specifications for “lean concrete backfill.”

A2 –

a) Yes, lean concrete will be required as backfill on all culvert pipes to prevent leakage and subsequent frost heave of culverts.

b) See Section 614 of the FP 14 for requirements of lean concrete backfill.

Q3- Will contractors be able to draw water from the Lake for this project?

A3- The only construction water locations are noted in section 105 of the SCR’s. Any other sources are the responsibility of the contractor.

Q4- Can the 14,600 Cy of waste material be placed in the quarry area?

A4- Excess material could be incorporated into the Contractor’s remediation and restoration plan or for obliteration site’s or other on-site locations as approved by the CO.

Q5- Please verify the Outlet pipe detail provided under Standard underdrain system 605-A.

Do all these outlet pipes need to be backfilled with lean concrete backfill.

A5- No they do not require lean backfill. See section 605 of the FP-14

Q6- Would tree clearing be allowed in advance of the project start date?

A6- Contractors should assume no on-site work will be done prior to April 1 per 108.01 (it is pretty clear). The Government will consider value engineering proposals from the selected firm, if they have a plan to start sooner.

December 8, 2016

Q7- Does the engineer have an assumed/estimated unit weight for the Aggregate Base Course on the project?

A7- No. The Contractor is responsible for making their own assumptions based on the geotechnical report, the test pit sample tests, and the grading in Table 703-2.

Q8- Item 52.216-1 on Page B-16 states that the type of contract will be FIRM FIXED PRICE. Can the engineer please explain if/how this differs from a conventional unit price contract?

A8- The contract will be a firm fixed price contract based upon unit prices and unit quantities. Each line item has a “measurement” and “payment” section in the FP-14 or SCR’s that detail how each item is paid. The CFLHD is not familiar with a “conventional unit price contract” but the firm fixed price contracting method is the method traditionally used by FAR (Federal Acquisition Regulation) based contracts for highway construction projects.

Q9- Section 105.2 on Page E-4 identifies a county water source located at STA 396+80 Right. Will there be a cost to the contractor for water used from this source?

A9- The County will not charge the Contractor for use of the water source. However, as stated in 105.02 if restrictions are required, then alternate sources and additional requirements may be necessary. The Government makes no guarantee in the quantity of water available at the source, or if restrictions are put in place, if fees will be charged by others.

Q10- Section 107.01 on Page E-9 states that the contractor must amend the SWPPP and site plan when the new permit goes into effect (after 2/16/2017) to meet the new permit conditions. How will costs for items required by the new permit, which were not foreseeable prior to submission of the bid proposal, be compensated?

A10- Since the SWPPP is a living document, updates to the document are required as the project proceeds whether there is a new permit or not. The preliminary SWPPP is written to meet the current permit (2012) requirements and will mostly need updated references in a few places and the copy of the permit replaced. If there are new requirements that require additional devices or practices that are not apparent at this time, those will be addressed as any other changed condition would be.

Q11- What type of equipment will meet the requirements of Item 62202-1000 Materials Transfer Vehicle?

A11- Refer to 401.05

Q12- Is this project exempt from any federal, state or local taxes?

A12- Per FAR 52.229-3 Federal, State, and Local taxes- the contractor is responsible for identifying all taxes and including those taxes in their unit prices. The CFLHD cannot issue tax advice and suggests consulting with a tax professional if you have questions concerning taxes.

Q13- There is no bid/pay item provided for a traffic control inspector or traffic control supervisor (such as Item 63501-1000) on the project. Can a pay item for this be provided?

A13- The cost of the traffic control supervisor is to be included in the other 635 items.

Q14- FHWA standard plan sheet C204-50 includes a detail for Furrow Ditch, are any of these required on the project and if so where/how much?

A14- No locations requiring furrow ditches have been identified within the project limits at the time of the bid. If any locations requiring a furrow ditch are identified during construction, payment will be included in roadway construction. See Subsection 204.16(a)(1)(d).

Q15- What is the contractor to do with stumps?

A15- See sections 201 and 203.05 of the FP-14 and the Invitation for Bid.
