About this file
This document is a Construction Waste Management Plan (CWMP) guide issued by the City of Palm Desert, Building and Safety Division, establishing waste diversion requirements for construction and demolition projects within the jurisdiction. The City of Palm Desert has adopted the 2022 California Green Building Standards Code (CALGreen) through Ordinance 1388, which mandates that all qualifying construction and demolition projects achieve a minimum 65% diversion rate for non-hazardous debris through recycling, salvage, or reuse, with 100% diversion required for land-clearing debris including dirt, rock, and landscape materials. The CWMP requirement applies to residential projects (new construction, additions, and alterations of low- and high-rise residential buildings, apartments, condominiums, ADUs, and accessory structures) and commercial or non-residential projects (new construction, building additions of 1,000 square feet or greater, and alterations with permit valuations of $200,000 or above). Applicants must submit a completed CWMP with all building permit applications to the City's Development Services Center, and separate CWMPs are required for demolition conducted prior to permit issuance. Monthly recycling progress reports must be provided to the District Environmental Coordinator throughout the project, and a final diversion report approved by Burrtec (the City's exclusive franchised waste hauler) must be uploaded to the e-TRAKiT portal before issuance of Certificate of Occupancy, Temporary Certificate of Occupancy, or Final Inspection.
Non-compliance with Ordinance 1388 constitutes a misdemeanor punishable by up to six months imprisonment, a fine of up to $1,000, or both, with additional remedies including stop work orders or delays in final approval. All construction and demolition waste must be hauled exclusively by either the contractor (self-hauling with a permit) or by Burrtec Waste & Recycling Services; no other haulers are permitted. The document provides a standardized CWMP form requiring applicants to identify anticipated waste materials (appliances, asphalt, cardboard, concrete, drywall, metals, roofing, wood, green waste) and specify whether materials will be reused, recycled, or disposed at designated facilities. Free assistance and guidance are available from the City's District Environmental Coordinator at (760) 674-1026. The Building and Safety Division can be contacted at (760) 776-6435 or permitcenter@palmdesert.gov for permit-related inquiries.

Construction Waste Diversion Program City of Palm Desert - Building and Safety Division Phone (760)776-6435 Email: permitcenter@palmdesert. gov Website: https:// www.palmdesert. gov
PLEASE CONTACT BURRTEC AS OUTLINED BELOW
Construction and Demolition ( C&D) waste accounts for 29% of materials going into landfills. The City of Palm Desert is mandated by State law to help reduce the amount of material hauled to landfills through the California Green Building Code ( CALGreen). The City has created a process to make compliance easy through the C&D Diversion Program, and it all starts with a Construction Waste Management Plan.
A Construction Waste Management Plan ( CWMP) is necessary to demonstrate compliance with State regulations for your C&D project. A CWMP ensures that C&D projects salvage, reuse, or recycle all inert solids ( i.e. concrete, drywall, brick, asphalt, glass, plaster, clay, etc.) and divert at least 65% of all other debris generated by your project. This 65% diversion requirement, including 100% diversion of land clearing debris ( i.e., dirt, rock, landscape material, etc.), is a mandatory requirement of the CALGreen requirements ( See Palm Desert Environmental Programs!!)
The following projects are required to submit a Construction Waste Management Plan and comply with CALGreen:
Residential
1. Newly constructed low- and high- rise residential buildings such as:
Hotels, motels, and lodging houses.
Apartments and condominiums.
One and two-family dwellings and townhouses.
Dormitories, shelters for homeless people, congregate residences, and employee housing.
Other types of dwellings containing sleeping accommodations with or without common toilets or cooking facilities.
Factory- built housing.
Accessory Dwelling Units ( ADU) built in accordance with the California Building Standards Code.
Live/Work Units.
Accessory structures serving residential buildings.
2. Additions or alterations of existing residential buildings where the addition or alteration increases the building’ s conditioned area, volume, or size. The CALGreen requirements are only applicable within the specific area of addition or alteration.
Commercial or Non-residential:
1. Newly constructed buildings.
2. Building additions of 1,000 square feet or greater.
3. Building alterations with a permit valuation of $200,000 or above ( for occupancies with the California Building Code. Code requirements for additions and alterations shall only apply to the portions of the building being added or altered within the scope of the permitted work.
Note: Minor electrical, plumbing, and mechanical permits are exempt.
