About this file
This is a Bid Guarantee (Bid Bond) document for the City of Palm Desert, California, required for the Demolition and Site Stabilization of Two City-Owned Properties Project (Project No. SFA00001). The bond secures the bidder's commitment to the project, which involves demolition and site stabilization services at two City-owned properties located at 44911 Cabrillo Avenue and 44845 San Clemente Circle in Palm Desert. The work encompasses all labor, supervision, equipment, materials, tools, transportation, permits, utility coordination, hazardous materials abatement and disposal, demolition, debris removal, site clearing, backfill, grading, and stabilization necessary to complete the project in accordance with the Contract Documents. The successful bidder must coordinate and complete the work at both locations, including all required regulatory compliance, inspections, documentation, site protection, and project closeout, leaving the sites clean, secure, properly graded, and stabilized to the City's satisfaction.
The bid bond amount is established at ten percent (10%) of the total bid price submitted by the principal contractor. The bond is issued jointly by the principal (contractor) and surety and becomes null and void if the principal does not withdraw its bid within the specified timeframe, is awarded the contract, and provides all required documents to the City. The surety waives notice of any changes, extensions, alterations, or additions to the Contract Documents and assumes liability for all litigation expenses, including attorneys' fees, court costs, and expert witness fees, should the City need to enforce the bond. The document requires notarized acknowledgments from both the Contractor/Principal and the Surety's Attorney-in-Fact, with the latter requiring an attached Power-of-Attorney certificate from the bonding company's local representative. Alternatively, bidders may submit other forms of bidder's security such as cash, certified check, or cashier's check in lieu of the bid bond.
