About this file

This is a Construction Supplemental document effective July 2024 for a Maryland state contract opportunity related to Sand and Spring Run Subsidence Repair. The supplemental outlines additional requirements and contractual obligations applicable to the construction solicitation, including security protocols, bonding requirements, retainage provisions, and American-manufactured goods specifications. The document modifies Section 2 of the original solicitation and establishes mandatory compliance standards for contractor personnel working on State premises.

The security requirements mandate that all contractor personnel display company identification badges visibly and comply with State site requirements, including potential escorting and badge issuance procedures. Contractors must remove any personnel who fail to adhere to these security specifications, and the State reserves the right to request employment authorization documentation for non-United States citizens and to refuse individuals with specified criminal convictions. The solicitation includes bid or proposal bond notice requirements for construction contracts exceeding $200,000 as of October 1, 2025, and construction contract retainage provisions per COMAR 21.06.06.01. All goods furnished under the contract must be American-manufactured as defined in COMAR 21.11.15.04, unless the goods qualify as emergency life safety items or the State determines that American-manufactured goods are unavailable, unreasonably expensive, of substantially lower quality, or inconsistent with the public interest. Bidders must certify compliance with American-manufactured goods requirements in the Certification of American-Manufactured Goods attachment and disclose any exceptions prior to contract award.
