About this file
Amendment No. 22 to Contract No. LAB028 is an amendment between the Florida Department of Environmental Protection and Test America Laboratories, Inc., located in Knoxville, Tennessee. This amendment modifies the terms of an indefinite delivery contract for overflow laboratory services related to the analysis of inorganic and organic samples, originally effective December 12, 2007.
The amendment revises Paragraph 5 to establish a maximum contract compensation of $584,208.62, representing an increase of $75,000.00 over the five-year contract term, with annual funding increments set at $40,000.00. The contractor shall be compensated on a fee schedule basis in accordance with the Fifth Revised Rate Schedule (Attachment C-5). The Department retains the right to provide funding increments on an as-needed basis and reserves the right to increase the ceiling amount upon contract renewal. The rate schedule includes detailed pricing for analytical services organized by test group: inorganics (metals, general chemistry, nutrients, and mercury analyses ranging from $6.59 to $75.56 per analysis), potable water and drinking water act methods ($14.11 to $30.00 per analysis), non-potable water, solids and chemical materials using RCRA methods ($6.59 to $55.00 per analysis), organics including volatile organic compounds and pesticide analyses ($47.05 to $228.17 per analysis), and radiological group analyses ($45.00 to $90.00 per analysis). Additional provisions require invoicing within thirty days of analysis completion or thirty days after submission of the analysis report, with final invoices submitted no later than thirty days after contract completion. The Department may request rate increases or decreases up to five percent annually, subject to written justification and formal amendment. The amendment incorporates public records requirements as specified in Exhibit A and includes turnaround time markups ranging from thirty percent for five business days to one hundred percent for twenty-four-hour analysis, plus a $2.50 per sample waste management fee.
