About this file
This is Amendment No. 14 to DEP Contract No. LAB028, a contract between the Florida Department of Environmental Protection (FDEP) and Testamerica Laboratories, Inc. The contract was originally entered into on December 12, 2007, and has been amended multiple times, with this amendment dated October 5, 2014. The contract manager for FDEP is Sara Armour. This amendment document includes a Separation of Duties Notice dated September 26, 2014, requiring that adequate separation of duty be maintained in the procurement of goods and services, with Mary Quinsey identified as the Contracts Office representative.
Amendment No. 14 decreases the funding increment amount of the contract from $355,520.26 to $351,073.49, representing a decrease of $4,446.77. The amendment adds new language establishing requirements for deliverable acceptance and performance standards. If the FDEP deems a deliverable unsatisfactory, the contractor must resubmit services or provide corrective action at no additional cost. A Corrective Action Plan (CAP) must be submitted within ten calendar days of notification of deficiency, with FDEP having ten calendar days to approve or reject the proposed CAP. The contractor then has ten calendar days to commence implementation. Failure to respond to CAP requests or correct deficiencies may result in contract termination. The Department retains the right to exercise additional remedies as permitted by the contract.
