About this file
This is Amendment No. 16 to Agency Term Contract No. GC854, a rate increase amendment executed between the Florida Department of Environmental Protection (Department) and Environmental Risk Management, LLC, DBA ERMI (Contractor) on May 8, 2024. The contract, originally executed on February 21, 2014, provides petroleum contamination site response action services in the South Region of Florida. This amendment modifies only the rate schedule and does not add, delete, or modify any line items contained in the original contract.
The amendment implements rate increases to the Contractor's Rate Schedule effective for all new work assignments offered on or after June 10, 2024 (the Rate Change Date), while all pre-Rate Change Date work assignments continue to apply the prior rate schedule. The rate increases across 500+ pay items range from approximately 4.35% to 5.00%, with most increases at exactly 5.00%, which represents the maximum allowed under provision 11.B.ii of the contract. The new rates apply to mobilization and equipment costs, drilling and boring services, environmental sampling and analysis, site assessment and remedial action planning, remedial system installation and operation, and professional services including engineering and geological oversight. The Department reviewed and approved the Contractor's detailed justification for the rate increases, which did not exceed the contractual maximum. Attachment D, Rate Schedule (V3.6) reflecting the new rates became effective following data entry on June 10, 2024.
