About this file
This is Amendment No. 14 to Agency Term Contract No. GC854, a language amendment with rate increase between the Florida Department of Environmental Protection (DEP) and Environmental Risk Management, LLC, DBA ERMI. The contract, originally executed on February 21, 2014, provides petroleum contamination site response action services in the South Region of Florida.
The amendment implements rate increases to the contractor's Rate Schedule (Attachment D, Version 3.5) effective on the Rate Change Date of June 1, 2023, for all new work assignments offered on or after that date. The rate increases apply to approximately 400+ pay items covering mobilization services, drilling and boring operations, sampling and analysis activities, soil and water testing, remedial action services, system operations and maintenance, and professional services. The majority of rate increases are approximately 8.00%, with some items ranging from 1.43% to 7.99%, reflecting variations in cost adjustments across different service categories. The amendment specifies that all pre-Rate Change Date work assignments and previously offered work assignments will continue to apply the contractor's prior rate schedule. The contract includes an updated provision regarding well pad documentation requiring photo evidence that drums meet the industry standard of being 75% full. Additionally, the amendment clarifies that no new Purchase Orders or Task Assignments shall be issued after the renewal term, though the restated contract continues for up to twelve months thereafter to complete any assignments issued during the renewal term.
