About this file

Amendment No. 9 to Agency Term Contract No. GC840 is a rate adjustment document between the Florida Department of Environmental Protection (FDEP) and APEX COMPANIES, LLC. The contract, originally executed on February 23, 2014, provides petroleum contamination site response action services in the South Region of Florida. This amendment, effective June 19, 2020, modifies pricing for specified pay items within the existing indefinite delivery contract structure.

The amendment implements both rate increases and decreases across numerous service categories, with increases not exceeding the 5% maximum permitted under contract provision 11.B.ii. Rate adjustments apply only to new work assignments issued on or after the Rate Change Date of June 19, 2020, while all pre-Rate Change Date work assignments continue under the previous rate schedule. The revised rates cover a comprehensive range of petroleum remediation services including mobilization, drilling and boring operations, well installation and abandonment, sample collection and laboratory analysis, soil source removal, remedial system construction and operation, pilot testing, and professional engineering and geology services. Specific rate changes range from -5.00% to +5.00% across approximately 400 pay items, with the new Attachment D (V3.2) Rate Schedule establishing maximum billable rates for each service component. All other terms and conditions of the original contract remain in effect, with this amendment modifying only the rate structure without adding, deleting, or otherwise altering existing line items.
