About this file
This document is Amendment No. 12 to an Agency Term Contract (GC840) between the Florida Department of Environmental Protection (FDEP) and APEX COMPANIES, LLC. The contract, originally executed on February 23, 2014, provides petroleum contamination site response action services in Florida's South Region. This amendment implements a rate increase for specified pay items, effective for all new work assignments offered on or after the Rate Change Date of May 25, 2022. The amendment does not add, delete, or modify any existing line items; it solely adjusts pricing for designated services.
The amended contract includes 450+ pay items covering site assessment, drilling and boring, well installation and abandonment, sample collection, laboratory analysis, soil source removal, debris disposal, remediation system operations and maintenance, pilot testing, professional services, and reporting. Rate increases range from 5% to 15%, with the majority of items receiving 15% increases. Key service categories include mobilization charges ranging from $176.11 to $1,808.31 per round trip, laboratory analyses from $5.11 to $1,087.03 per sample, well installation costs from $20.52 to $1,453.02 per vault, soil excavation and disposal fees from $24.18 to $182.71 per cubic yard, and professional engineering oversight rates from $1,000 to $4,579.27 per test or system. The revised Rate Schedule (V3.4) applies only to new work assignments issued on or after May 25, 2022, while all pre-rate-change work assignments continue under the previous rate schedule. The Department was required to provide the contractor with tabulated rate changes within five business days of data entry.

WHEREAS, the rate changes authorized will be applicable only for new work assignments offered on or after the Rate Change Date (“New Work” assignments).
WHEREAS, the Department and Contractor wish to establish a date certain for the rate changes specified herein to be effective, following the execution of this Amendment and the Department’s data processing of the rate changes (hereinafter “Rate Change Date”); and, WHEREAS, the Contractor has requested that rate increases be made to Attachment D (V3.3) entitled "Rate Schedule" in accordance with provision 11.C of the Contract; and, WHEREAS, the Department has reviewed this justification and agrees with the requested increase(s); and, The Agency Term Contract No. GC840 (hereinafter "Contract") between the FLORIDA
