About this file
Summary
This is Amendment No. 16 to DEP Agency Term Contract No. GC840, a rate increase amendment executed between the Florida Department of Environmental Protection (FDEP) and APEX Companies, LLC on May 8, 2024. The contract, originally executed on February 23, 2014, provides petroleum contamination site response action services in the South Region of Florida. The amendment updates the Rate Schedule (Attachment D) from Version 3.5 to Version 3.6, effective for new work assignments offered on or after the Rate Change Date of June 10, 2024.
The amendment modifies rates for 271 pay items across multiple service categories including site mobilization, drilling and boring operations, well installation and abandonment, soil and water sampling and analysis, excavation and disposal, remediation systems and pilot testing, and professional services. Rate increases range from 0% to 5.00%, with the majority of adjustments at or near the maximum 5% threshold permitted under contract provision 11.B.ii. The Agreed New Rates serve as the maximum authorized compensation for each line item. Rates for pre-amendment work assignments remain unchanged under the prior Rate Schedule. The FDEP provided notice of the rate changes to the contractor within five business days of data entry, with the effective date established in the Department's processing system.
