About this file

This document is a Wage Theft Prevention certification form (CM-16) established by the City of Boston for all prospective vendors bidding on City contracts. The form requires vendors to certify compliance with the City's Executive Order designed to prevent wage theft and ensure adherence to Massachusetts wage and hour laws (G.L. c. 149, c. 151) and the Fair Labor Standards Act. Vendors must select one of two certification options: either certify that neither they nor any subcontractor has been subject to federal or state criminal or civil judgment, administrative citation, final administrative determination, order, or debarment resulting from wage and hour violations within three years prior to bid submission, or disclose such violations and include supporting documentation with their proposal. This form must be completed and signed by the vendor, included with all bids and proposals, and for multi-year contracts, must be renewed annually on the contract anniversary date.

Vendors who fail to provide the required certification or disclosures will have their bids rejected. All vendors must also certify that they will report any federal or state criminal or civil judgments, administrative citations, final administrative determinations, orders, or debarments resulting from wage and hour violations imposed while a bid is pending or during the contract term within five days of receiving notice. Vendors awarded contracts who have disclosed prior wage violations must furnish monthly certified payrolls to the City for all employees working on the contract and may be required to obtain a wage bond or other suitable insurance equal to one year's aggregate gross wages for all employees. Additionally, contractors must post the Massachusetts Wage and Hour Laws notice at conspicuous locations to inform employees of protections under applicable state and federal law. Vendors subject to state or federal debarment for wage law violations are prohibited from contracting with the City, and the City may terminate contracts upon finding or order of debarment.
