Project Description
The Eastern Federal Lands Highway Division (EFLHD) of the Federal Highway Administration, in cooperation with the United States Forest Service (USFS), is proposing to conduct repairs on multiple forest service roads (FSRs) in George Washington and Jefferson National Forest (Forest).
The road repairs are needed to address storm damage that occurred in spring 2020, which resulted in flooding and erosion of road surfaces, failure of road embankment slopes, scouring, and damage to drainage systems and several low water crossings throughout the Forest.
A summary of the damages at each site and the proposed repairs is provided below.
Blackhorse Gap East Road (FSR 186) o The triple barrel culvert low water crossing at Day Creek became clogged with debris and overtopped, resulting in a loss of roadway fill and retaining fill, as well as damage to the culvert base.
EFLHD NEPA Categorical Exclusion Form EFL-TM-ENV-23(02) o Proposed repair work includes debris removal, replacement of the triple barrel culvert low water crossing with a single open bottom concrete box culvert, resurfacing and fortifying of both approaches, and placement of riprap to protect/stabilize adjacent stream banks. A temporary bridge would be required to facilitate replacement of the low water crossing.
Dry Run Road (FSR 14) o Experienced road embankment slope failures and bridge and roadway scouring from debris laden flood waters.
o Proposed repair work includes 0.5-mile of roadway resurfacing, culvert replacement, slope revetment repairs along to Francis Mill Creek, and placement of riprap at scour holes of East Fork Dry Run and Francis Creek Mill bridge abutments.
Punch and Judy Road (FSR 618) o Experienced road embankment slope failures at several locations across approximately 326-linear feet. Area 1 is approximately 30-feet high x 12-feet width; Area 1A is approximately 28-feet high x 20-feet width; Area 2 is approximately 31-feet high x 35-feet width; Area 3 is approximately 30-feet high.
o Proposed repair work includes repairing failed road embankment slopes with gabions, vegetation matting, gravel road resurfacing, and placement of riprap at the outlet of an existing 18-inch culvert.
Little Stony Road (FSR 700) o Experienced large embankment slope failures (approx. 80-feet high x 54-feet long) due to heavy rain and underground seepage.
o Proposed repair work includes deep patch embankment repair using gabions, soil nails and vegetation matting.
Hussy Mountain Horse Camp Road (FSR 14A) o The 2020 high-water storm event and resulting debris flow, overtopped and scoured out the substructure of a USFS self-built, low-water crossing at the Hussy Mountain Horse Camp recreation site, resulting in closure of the access road and damage to utilities.
o Proposed repair work includes raising the road profile along 0.1-mile of the roadway approximately 2-3 feet and resurfacing with crushed aggregate, small culvert replacement, wood fence replacement, replacement of the low water crossing with a 10-foot x 4.5-foot concrete open bottom box culvert, placement of riprap stream bank revetment (approx. 60 linear feet), and road surface repairs at both approaches to the low water crossing.
EFLHD NEPA Categorical Exclusion Form EFL-TM-ENV-23(02)
Environmental Commitments and Mitigation Measures The proposed activities would occur within the existing developed roadway corridors.
Impacts to adjacent forests and streams would be avoided to the extent possible.
Best management practices (BMPs) would be utilized for erosion and sediment control to minimize potential impacts to nearby and adjacent water bodies.
Temporary lighting used during construction would be directed away from suitable bat habitat (away from trees) during the active season between April 1 – November 15.
No tree trimming/tree removal will occur between April 1 – November 15.
No in-water work will occur at Little Stony Road.
No in- water work will occur between April 1 – September 30 at Punch and Judy Road.
No in-water work will occur between March 15 – June 30 at Dry Run Road and Hussy Mountain Horse Camp Road
Summary of Section 7 of the Endangered Species Act Compliance FHWA, acting as the lead federal agency for compliance under Section 7 of the Endangered Species Act (ESA), obtained official species lists from the U.S. Fish and Wildlife Service’s (USFWS) Information for Planning and Consultation (IPaC) system on 5/28/2024 for Punch and Judy Road (Project Code 2022-0042621), 9/4/2024 for Little Stony Road (Project Code 2022- 0042506), 5/21/2024 for Hussy Mountain Horse Camp Road (Project Code 2022-0042526), 6/21/2024 for Dry Run Road (Project Code 2022-0042640), and 11/13/2023 for Blackhorse Gap East Road (Project Code 2022-0042653).
FHWA submitted 6-step project review packages under each Project Code along with completed Self-Certification Letters per the USFWS Virginia Field Office online project review process guidance. In the project review packages, FHWA determined the proposed action would have no effect or may affect but is not likely to adversely affect thirty-three listed and proposed species, as indicated in each project review package. Per 50 CFR § 402.13(c)(2) and the Virginia Field Office’s online project review process guidance, if USFWS does not respond to the project review package within 60 days of the submission, the Self-Certification Letter and project review package “complete the review of the project in accordance with the ESA of 1973, as amended”.
Only one comment was received from USFWS within the 60-day submission window regarding the effects determinations for Little Stony Road (Project Code 2022-0042506). FHWA resubmitted the project review package per discussion with USFWS with updated effects determinations. No comments were received from USFWS on the four other project review packages.

Summary of Section 106 of the National Historic Preservation Act Compliance On 11/6/2024 and 11/12/2024, the USFS – acting as the lead federal agency for compliance under Section 106 of the National Historic Preservation Act – found that the proposed project activities fall under a standard road maintenance activity, which is within the scope of their Programmatic Agreement with the Virginia Department of Historic Resources. Compliance documentation from the Assistant Forest Heritage Program Manager is enclosed.
Additional Agency Coordination and Compliance On 6/17/2021, the USFS District Ranger finalized a Finding of No Significant Impact (FONSI) for the Bobblets Gap Vegetation Project Environmental Assessment (EA) in George Washington and Jefferson National Forests. The scope of work covered within the EA and FONSI included safety improvements to FSR 186, such as day-lighting the roadway, as well as repairs the triple barrel culvert crossing and approaches at Day Creek.
FHWA coordinated with state-level biological resource agencies as a courtesy. Project reviews were requested through the Virginia Department of Conservation and Recreation’s (VDCR) Natural Heritage Data Explorer Web Service for the repairs on Blackhorse Gap East Road, Little Stony Road, Hussy Mountain Horse Camp Road, and Punch and Judy Road. VDCR responded on 11/28/2023 (Blackhorse Gap) and 12/5/2023 (Little Stony, Hussy Mountain, Punch and Judy) with recommendations to reduce or minimize impacts to sensitive resources and habitats within and adjacent the project vicinity, including the use of strict erosion and sediment control measures and the minimization of disturbance to the extent practicable. VDCR also noted that the Tennessee dace (Chrosomus tennesseensis), a state listed species, may occur in Punch and Judy Creek and would require time of year restrictions for in water work.
Prior to construction, erosion and sediment control plan review and approval from the Virginia Department of Environmental Quality (DEQ) will be conducted per the consolidated Virginia Erosion and Stormwater Management Act (Act) – previously the Virginia Erosion and Sediment Control Act and the Virginia Stormwater Management Act. Additionally, any project sites which do not meet the “routine maintenance” exemption for compliance with the water quantity and water quality technical criteria under the Act will be reviewed by DEQ. DEQ may waive the requirements for the preparation and implementation of a stormwater management plan based on site conditions.

Good Morning Michael, After reviewing the Cultural Resources Atlas, GIS database, and the Virginia Cultural Resources Information Service, we have determined that the following locations are devoid of cultural resources, and that the planned activities fall within standard road maintenance as described within our Programmatic Agreement with the VA DHR; therefore, the following road repair locations can proceed and have no further Section 106 concerns:
1. Black Horse Gap Road (37°24'24.3"N 79°44'45.4"W)
2. Little Stony Road (36°51'52.2"N 82°30'36.4"W)
3. Punch and Judy Road (37°00'13.7"N 81°27'40.0"W)
4. Hussy MTN Horse Camp Road (36°46'19.0"N 81°08'36.4"W)
5. East Fork Dry Run Bridge (36°46'19.3"N 81°10'36.8"W)
However, the Francis Mill Creek Bridge and the Dry Run Creek Bank Failure in Wythe County requires further investigation and field visits. We’ll be able to visit these locations prior to the November 19-20 field trip and determine whether we’ll need to ask questions or set implementation guidelines.
We also need locations for the temp roads for the trail bridge repair before we can make a determination on the section 106 requirements.

Hi Michael:
We were able to go out and visit the final two locations (Francis Creek Bridge and Dry Run Creek Failure) today and determined that the resources we had concerns about would not be impacted by the repairs necessary. We will not be attending the 19-20th November field trip.
This project has no further Section 106 concerns and can proceed as planned.
