About this file
This is a bid specification document issued by the City of Minneapolis Department of Public Works for the procurement of fine aggregate (street sand) under Event 4213. The solicitation requests the production, furnishing, and delivery of fine aggregate with a good faith estimate of 10,000 tons needed by the City. The material must consist of natural or crushed angular sand meeting specific gradation requirements per MnDOT 2025 Standard Specifications, with particles of durable rock free from injurious coatings, clay lumps, and organic matter. All material must be washed clean, drained for at least 12 hours prior to delivery, and comply with established moisture content limits. Material must be delivered via end dump trucks in quantities not exceeding 600 tons per day to designated City warehouses within 24 hours of order placement. The contract will be awarded to the lowest responsive and responsible bidder for an initial one-year term with options to renew for up to two additional 12-month periods.
Proposals must state a firm price per ton for the entire contract period, with the unit price including all costs associated with supply and delivery, including fuel and service charges. The maximum contract amount is $175,000, with the contract terminating early if this amount is reached during any contract term. Prices must remain firm during the initial contract period; however, escalation may be permitted for renewal terms based on documented industry-wide, regional, or operational cost increases submitted 60 days prior to contract year-end, not to exceed the Consumer Price Index or five percent, whichever is higher. Bidders must demonstrate a minimum of five years in business and meet all applicable Federal, State, and local licensing and certification requirements. The City reserves the right to reject any or all bids and assess liquidated damages of $1.00 per ton per day for materials not delivered or failing to meet specifications, with damages accruing for up to five days per specific order.

The Contractor must reimburse the City for all costs in excess of the Agreement price when purchases are made in the open market; or, in the event that there is a balance the City owes to the Contractor from prior transactions, an amount equal to the additional expense incurred by the City as a result of the Contractor's nonperformance shall be deducted from the balance as payment.
If the Contractor is prevented from making delivery of materials by reason of any strike among the workmen of the manufacturers of the materials or among the employees of the common carriers necessarily depended upon to transport the said materials to the City, or by government regulations preventing the performance of the contract, or by other like reasons beyond the control of the contractor, the foregoing provisions for liquidated damages shall be deemed to be waived by the City.
Section l1. LIQUIDATED DAMAGES – The contract must provide that in case of failure on the part of the Contractor to deliver material under the contract, of the quality and in the quantities as ordered by the City Purchasing Agent, and as provided for in the specifications, the Contractor is liable for liquidated damages in the sum of $1.00 per ton per day for materials ordered but not delivered, or not up to specifications, to cover the damages to the City resulting from the delay and interference with its operations. The accrual of liquidated damages will continue until the City is able to make arrangements for the purchase of the necessary materials in the open market, but will not continue for a period in excess of five days for the failure to deliver any one specific order. The liquidated damages provided for in this paragraph will be in addition to the damages provided for in Section 7 of these specifications, resulting from the additional cost to the City for the purchase of materials from other sources.
Section 12. RIGHTS OF THE CITY – The City reserves the right to reject all or any part of any bid, waive informalities, and award the contract to the lowest responsive and responsible contractors to best serve the interest of the City. The maximum contract amount for this informal bid is $175,000. The overall total of the contract award cannot exceed $175,000. If the maximum amount is reached during a contract term, the City will have to issue a new bid and terminate the contract early.
Section 15. PRICE ESCALATION – Prices must be firm for the initial contract period. After the initial contract period, an escalation may be allowed for any extensions based upon a demonstrable industry wide, regional and/or operational increases in the Contractor’s costs. In order for documentary evidence to be considered, it must be submitted to the City of Minneapolis Purchasing Department sixty (60) days prior to the end of the current contract year. The exact amount of escalation, if any, will be governed by the validity of the documentary evidence submitted.
