About this file

This is a Bid Bond Instructions document issued by the State of Maryland for a contract opportunity to replace the HVAC system at the Range Operations Building in Glen Arm, Maryland (Project M-382-270-003). The bid bond serves as a guarantee that a bidder will execute the necessary contractual documents and provide required performance and payment bonds upon acceptance of their bid. Bidders must submit a bid bond equal to at least five percent of their total bid amount. The Principal and Surety bind themselves jointly and severally to the State of Maryland for the penalty amount specified in the bond. Upon bid acceptance by the State, the Principal has ninety days (or as otherwise specified) to execute any required contractual documents and provide necessary bonds within ten days of receiving forms, or the difference between the Principal's bid and the amount for which the State contracts with another party—not to exceed the bond penalty—becomes due to the State.

The bid bond document provides detailed instructions for completion based on the Principal's business structure: Individual Principal, Partnership Principal, or Corporate Principal. All signatures must be executed in the presence of a witness, and seals must be affixed by both the Principal's entity and the Surety. The original bid bond must include original corporate seals from both the Principal and Surety, with an original Power of Attorney attached. The Surety's obligation remains valid even if the State extends the bid acceptance period by up to an additional ninety calendar days, with notice to the Surety being waived. The completed document must be approved as to form and legal sufficiency by the Maryland Department of General Services' Assistant Attorney General before submission.
