About this file

This is a Standard Proposal Bond Form for Non-Construction submitted to the Virginia Lottery in response to RFP No. [Not Specified] for an iLottery System, Services, and Support solution. The proposal bond guarantees that the selected offeror will not withdraw their proposal during the 365-day period following proposal opening and will enter into a formal contract with the Virginia Lottery within ten days of receiving notice of contract award. The bond is executed by the Principal (the Offeror) and a Surety and is payable to the Virginia Lottery and the Commonwealth of Virginia. The proposal bond amount is calculated as a percentage of the total proposal value, though the specific percentage is not detailed in the template. If the Principal withdraws their proposal within the specified period or fails to execute the contract and provide required bonds within ten days of award notification, both the Principal and Surety become jointly and severally liable for the difference between the proposal amount and any higher cost incurred by the Virginia Lottery to procure the services from an alternative vendor, up to the amount of the proposal guarantee.

The bond must be signed and sealed by authorized representatives of both the Principal and the Surety, with the Surety's representative appearing before a notary public as an attorney-in-fact. The Surety must demonstrate legal authorization to provide bonding services in the Commonwealth of Virginia. The bond is governed by Virginia law, and any litigation arising from the bond shall be brought in the courts of the Commonwealth, specifically in the City of Richmond, Virginia. The notarized affidavit and acknowledgement of the attorney-in-fact must accompany the bond, confirming the authorization and validity of the power of attorney under which the Surety executes the instrument.
