About this file
This document is Attachment E to a contract, specifically the Protection of Personal Information Security and Breach Investigation Procedures and Practices Act for the Commonwealth of Kentucky. The attachment details requirements for vendors who receive Personal Information as defined under Kentucky Revised Statutes (KRS) 61.931, establishing comprehensive guidelines for securing and protecting sensitive personal data. The document mandates that vendors who have a contract or agreement with the Commonwealth and receive personal information must comply with specific security protocols, including immediate notification (within 72 hours) of any data breaches to multiple state offices, including the contracting agency, Office of Procurement Services, Commonwealth Office of Technology, and the NG-KIH Program Office.
The vendor agrees to several key obligations, including implementing and maintaining security procedures at least as stringent as those established by the Commonwealth Office of Technology, conducting prompt investigations of any breaches, and participating in cost-sharing for notification, investigation, and mitigation efforts. The Commonwealth reserves the right to withhold payments for any violations of the Identity Theft Prevention Reporting Requirements. The definition of "Personal Information" is broadly defined to include combinations of identifying data such as names, biometric information, account numbers, Social Security numbers, government-issued identification numbers, and other sensitive personal identifiers. Vendors must follow specific security protocols outlined in the referenced web link to the Commonwealth's information security policies.
