About this file

This is an Accessibility Contract Language attachment for IT Solutions established by the Commonwealth of Massachusetts for the RFQ 27ITS81MP01 DESE Website Modernization Services procurement. The document establishes comprehensive digital accessibility standards and requirements that vendors must meet when delivering digital products and services to the Commonwealth. Vendors are required to provide an Accessibility Conformance Report (ACR) based on the Voluntary Product Accessibility Template (VPAT) that evaluates conformance with Web Content Accessibility Guidelines (WCAG) 2.1 or 2.2 level A and AA success criteria, with the ACR being no more than 12 months old at submission. The contract mandates that vendors perform both automated and manual accessibility testing as part of their development and quality assurance processes, provide a Digital Accessibility Roadmap for any known accessibility violations, and deliver all documentation and training materials in compliance with digital accessibility standards. Vendors must remediate any identified accessibility violations at no additional cost to the Commonwealth and maintain accessibility compliance through all new releases and upgrades.

The contract imposes strict vendor remediation responsibilities, requiring vendors to promptly address any accessibility violations discovered during the term of the agreement, provide written validation of successful remediation, and grant the Commonwealth or third-party accessibility service providers access to test digital products at no additional cost. Failure to meet accessibility obligations may result in contract termination without penalty, cost deduction from outstanding payments for remediation performed by the Commonwealth, or non-renewal at contract expiration. Vendors are further required to coordinate with the Commonwealth regarding training attendees requiring accommodations and to indemnify the Commonwealth against claims arising from accessibility failures, with vendor liability capped at the greater of $100,000 or two times the total contract value.

For each Accessibility Violation, the roadmap includes the Web Content Accessibility Guidelines (WCAG) success criterion, component, location, violation description, severity level, status, target date for remediation, date remediated, and the technique used to remediate each violation.

f. “Digital Asset” refers to any item of value that exists in a digital format.

g. “Manual Accessibility Testing” refers to testing performed by a human tester using manual methods including the use of assistive technology.
