1.1 REFERENCES
The publications listed below form a part of this specification to the extent referenced. The publications are referred to within the text by the basic designation only. The latest version of the publication at time of award must be used.

1.2 DEFINITIONS
Definitions pertaining to sustainable development are as defined in JEGS, Section 01 57 19.00 33 “TEMPORARY ENVIRONMENTAL CONTROLS”, and as specified.
a. "Environmentally preferable products" have a lesser or reduced effect on the environment in comparison to conventional products and services. This comparison may consider raw materials acquisition, production, manufacturing, packaging, distribution, reuse, operation, maintenance, or disposal of the product.
b. "Indoor environmental quality" is the physical characteristics of the building interior that impact occupants, including air quality, illumination, acoustics, occupant control, thermal comfort, daylighting, and views.
c. "Operational performance" is the functional behavior of the building as a whole or of the building components.
d. "Sustainability" is the balance of environmental, economic, and societal considerations.
1.3 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for Contractor Quality Control approval. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following must be submitted in accordance with Section 01 33 00.00 33 SUBMITTAL

1.4 WORK COVERED BY CONTRACT DOCUMENTS
1.4.1 Project Description
This contract has two (2) Construction Sequences. The Contractor must perform on-site work on one sequence at a time. Do not perform on-site work on both sequences simultaneously. The order in which the Construction Sequences must be performed is subject to discussions with the Contracting Officer.
The Contractor must not perform on-site work during an Exclusionary Time Period (ETP) estimated to be between a minimum of 21 calendar days to a maximum of 90 calendar days. The maximum ETP has been considered in computing the time allowed for the performance of this contract.
1.4.1.1 Construction Sequence No.1 – Overhaul Hydraulic Operation System of Sluice Valve
The major work items include the following:
a. Overhaul hydraulic cylinder of hydraulic operating system for sluice valve.
b. Overhaul hydraulic pump unit of hydraulic operating system for sluice valve.
c. Remove and provide associated equipment of hydraulic pump unit.
d. Modify electrical power supply circuit and control circuit for hydraulic pump system.
e. Remove and provide lighting system in hydraulic pump pit.
This work does not include unforeseen site conditions.
1.4.1.2 Construction Sequence No.2 – Overhaul Caisson Dry Dock No.2
The major work items include the following:
a. Transport caisson from present dry dock to a floating dry dock or a commercial shipyard that is approved by the Contracting Officer for repairs, and return the caisson to the present dry dock after the repairs.
b. Install silt curtain and debris boom in front of the dry dock opening when the dry dock is filled with water.
c. Perform visual inspection and measuring thickness of steel plates/ framing members at whole areas except bottom part of the caisson being not measurable at the Dry Dock No.2, and report the intermediate visual inspection and measuring results to the Contracting Officer.
d. Perform measuring thickness of the bottom part not measured at the Contractor’s shipyard, and report the final visual inspection and measuring results in accordance with MIL-STD-1625(SH) (Safety Certification Program for Drydocking Facilities and Shipbuilding Ways for U.S. Navy Ships) dated 27 August 2009.

e. Provide structural repairs as required.
f. Remove and ensure proper disposal in accordance with applicable laws and regulations of existing flooding valve system (twelve motor driven butterfly valves, accessory including selsyn (self-synchronous) transmitters, short pipes), and provide flooding valve system.
g. Remove and ensure proper disposal in accordance with applicable laws and regulations of existing valve system for upper tanks and lower tank (eight motor driven butterfly valves, accessory including selsyn transmitters and short pipes), and provide valve system for upper tanks and lower tank.
h. Remove and ensure proper disposal in accordance with applicable laws and regulations of existing electric control panel system (seven panels and two connection panels) at upper deck with conduit wirings for power and control, and provide electric control panel system at upper deck with conduit wirings for power and control.
i. Remove and ensure proper disposal in accordance with applicable laws and regulations of existing vertical ladders and safety guards in lower tank and upper tanks, and provide vertical ladders in lower tank and upper tanks.
j. Remove and ensure proper disposal in accordance with applicable laws and regulations of existing exterior vertical ladders, and provide exterior vertical ladders.
k. Sandblast and repaint all exposed interior (void spaces: 2,594 sqm., upper and lower tanks: 1,394 sqm.) and exterior steel areas (1,204 sqm.)
of the caisson structure and fittings for preservation (348 sqm.).
l. Remove and ensure proper disposal in accordance with applicable laws and regulations of existing non-skid painting, rubber gaskets/fenders, and anodes (59 EA), and provide non-skid painting, rubber gaskets/fenders, and anodes (59 EA).
m. Provide draft marks and side marks on the exterior surfaces.
n. Change ship-type receptacle to general type (4 ea) in void spaces.
o. Remove and ensure proper disposal in accordance with applicable laws and regulations of existing air supply & exhaust fans (2 ea) in void spaces, and provide air supply & exhaust fans (2 ea) in void spaces.
p. Conduct stability analysis to ensure ample stability (i.e. GM value) are obtained even after the completion of this contract.
q. Clean drydock to remove contamination and debris created during the wet berthing period.
r. Dispose in accordance with applicable laws and regulations all waste/hazardous waste associated with the repair works.

s. All incidental related works, as described on plans and specifications.
Related work is defined as temporary work and relevant work which is required to accomplish this project.
This work does not include unforeseen site conditions.
1.4.1.3 Caisson General Removal Procedures
Caisson must be removed in accordance with the following general procedures.
The Contractor must verify the procedures with the original manufacturer.
a. Remove existing fall protection stanchions and chains installed around Dry Dock No.2, and temporarily store them in the Contractor’s facility.
b. Discharge the water from the lower ballast tank following the Dock Master’s instructions.
c. Fully open the 1000A butterfly valves to fill the dry dock with seawater.
d. Fully open the discharge valve in the upper water ballast tank to float the caisson.
e. Use a pusher boat to tow the caisson into the facility where the overhaul work is to be performed.
f. After removing the caisson, install silt curtains in the sill portion of Dry Dock No.2.
1.4.1.4 Cultural Resource Properties
Dry Dock #2 and Bldg 19A are listed cultural resource properties. Ensure that work does not cause any damage to these facilities. Notify the Contracting Officer any work that has the potential to impact Dry Dock #2 or Bldg 19A at least 15 days in advance and receive direction on how to proceed.
1.4.1.5 Contractor Operation of Caisson and Related Equipment
The Contractor must be responsible for the operation of the dry dock caisson and related equipment during the construction period.
1.4.1.6 Asbestos Containing Materials (ACM)
ACM is not assumed in this project.
1.4.1.7 Manage and dispose of Material Containing Lead/Paint with Lead
(MCL/PWL)
Existing material known to contain lead are existing as described in Section 02 41 00.00 33 “Deconstruction”. The Contractor must manage and dispose of the MCL/PWL in accordance with applicable codes, rules, and regulations, and Section 02 83 00.00 33 “Lead Remediation”.
1.4.1.8 Specifications and Standards
The specifications and standards referenced in this project specification, including addenda, amendments, and errata listed, will govern in all cases where references thereto are made. Apply the latest edition to the

In case of differences between these specifications or standards and this project specification or its accompanying drawings, this project specification and its accompanying drawings will govern to the extent of such differences. Otherwise, the referenced specifications and standards will apply. The requirement for packaging, packing, marking, and preparation for shipment or delivery included in the referenced specifications will apply only to materials and equipment that are furnished directly to the Government and not to materials and equipment that are to be furnished and installed by the Contractor.
1.4.2 Location
The work must be located at the U.S. Fleet Activities, Sasebo, approximately as indicated. The exact location will be shown by the Contracting Officer.

1.6 PROJECT SCHEDULE AND TIME CONSTRAINTS
1.6.1 Commencement and Completion of Work
The Contractor must be required to complete the entire work, ready for use, not later than 780 calendar days, including the mailing period, and an Exclusionary Time Period, after the date of Award. The mailing period includes the days for mailing of the Notice of Award and the submission of the required bonds, Certificate of Insurance, and pre-construction activities. The time for completion must include final clean-up of the premises.
1.6.2 Construction Sequence work
This contract has two (2) Construction Sequences. The Contractor must perform on-site work on one sequence at a time. Do not perform on-site work on both sequences simultaneously. Sequence of on-site work area will be determined under the direction of the Contracting Officer after contract award.
The Contractor must not perform on-site work during an Exclusionary Time Period (ETP) estimated to be between a minimum of 21 calendar days to a maximum of 90 calendar days. The maximum ETP has been considered in computing the time allowed for performance of this contract, but is not included in the Work Sequence table.

1.7 RELOCATION AND TRANSPORTATION
1.7.1 Temporary Relocation of Caisson
Transport caisson from the present drydock to a facility where the overhaul work is to be performed and return the caisson to the present drydock after completing the overhaul. The following facilities may be considered for the caisson overhaul. The final location is subject to the Contracting Officer’s approval:

a. Floating Dock
b. Commercial shipyard
Verify existing conditions as specified in Paragraph “Reuse of Materials and Equipment” in Section 02 41 00.00 33 “Deconstruction.”
1.8 OCCUPANCY OF PREMISES
As specified in Section 01 14 00.00 33 “Work Restrictions.”
1.9 EXISTING WORK
In addition to "FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements":
a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.
b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work must be in a condition equal to or better than that which existed before new work started.
c. Unless otherwise specified or indicated, existing objects which interfere to accomplish new work must be removed temporarily and reinstall them upon completion of the work.
d. Do not make opening at structural element without approval from 1st grade licensed architect (“Ikkyu Kenchiku-shi”) of Government.
1.10 ON-SITE PERMITS
The Contractor must, without additional expense to the Government, obtain all appointments, licenses, and permits required for the prosecution of the work. The Contractor must comply with all applicable local laws. Evidence of such permits and licenses must be provided to the Contracting Officer through FINS (Facility Impact Notification System) request before work commences.
1.10.1 Utility Connection Requests
Requests for utility connections must be made in writing to the Contracting Officer at least 15 calendar days in advance of the time required. Each request must state the system involved, area involved, and the nature of work involved.
1.10.2 Utility Outage Requests and Utility Connection Requests
Work must be scheduled to hold outages to a minimum. Restrictions to utility outage and/or Government operation are/is specified in section 01 14
00.00 33 “Work Restrictions.”
Requests for utility outages and connections must be made in writing to the Contracting Officer at least 15 calendar days in advance of the time

1.12 CONCILIATION CLAUSE
a. Any disagreement arising under this contract which is not resolved by the parties to this contract may be submitted to the U.S.-Japan Joint Committee for Conciliation in accordance with paragraph 10, Article XVIII, of the Status of Forces Agreement under Article VI, of the Treaty of Mutual Cooperation and Security between Japan and the United States of America.
b. Recourse to the Joint Committee for Conciliation for resolving disputes is available in addition to the procedures set forth in the Contract Disputes Act of 1978 and the Disputes Clause of this contract, 52.233-1. A request for conciliation by the Joint Committee, however, must not toll the time periods allowed under the Contract Disputes Act for appealing a contracting officer’s final decision to either the Armed Services Board of Contract Appeals or U.S. Court of Federal Claims.
c. Upon filing a request for conciliation with the Joint Committee, the Contractor must immediately notify the Contracting Officer in writing of the request.

Before beginning any work, survey the site and examine the drawings and specifications to determine the extent of the work.
The dry dock seat was undergoing repairs during the preparation of the design drawings for this project. Thus, the design drawings may vary from

1.2 SUBMITTALS

1.3 RESTRICTIONS ON OPERATIONS
1.3.1 Coordination with Other Work
The Contract Clause entitled FAR 52.236-8 "Other Contracts".

1.3.2 Caisson Removal Operation
Lifting of the caisson by crane is not permitted as it may cause deformation.
1.4 SPECIAL SCHEDULING REQUIREMENTS
a. Permission to interrupt any Activity roads and/or utility service must be requested in writing a minimum of 15 calendar days prior to the desired date of interruption.
b. Work Sequence: As specified in Section 01 11 00.00 33 “Summary of Work”.
c. Have materials, equipment, and personnel required to perform the work at the site prior to the commencement of the work.
d. The Government will perform normal operations at areas that will not be affected by Contractor’s work during the entire construction period.
Conduct construction so as to cause the least possible interference with normal operations of the activity.
e. Maintenance of Traffic: As specified in Section 01 50 00.00 33 “Temporary Facilities and Controls”.
f. The work under this contract requires special attention to the scheduling and conduct of the work in connection with existing operations. Identify on the construction schedule each factor which constitutes a potential interruption to operations.
g. Remove construction debris, waste materials, packaging material and the like from the work site daily.
h. Contractor must notify the Contracting Officer at least 90 days in advance of the planned start of work on the hydraulic cylinder.
1.5 CONTRACTOR ACCESS AND USE OF PREMISES
1.5.1 Activity Regulations
Ensure that Contractor personnel employed on the Activity become familiar with and obey Activity regulations including access, safety, environment, fire, traffic and security regulations. Provide written "General Authorization to Work on Base" to the Security Office, Commander Fleet Activities, Sasebo. Keep within the limits of the work and avenues of ingress and egress. To minimize traffic congestion, delivery of materials must be outside of peak traffic hours (6:30 to 8:00 a.m. and 3:30 to 5:00 p.m.) unless otherwise approved by the Contracting Officer. Ensure allowable maximum vehicle length to carry in elongated material via the Contracting officer. Wear safety gears (such as hard hats, high visibility vest) with the Contractor's name prominently displayed, in construction site and designated areas. Do not enter any restricted areas unless required to do so and until cleared for such entry. The Contractor's equipment must be conspicuously marked for identification.
1.5.1.1 Subcontractors and Personnel Contacts
Within 15 days after the date of Award, furnish a list of contact personnel of the Contractor and subcontractors including the names, job titles, COMFLEACT Sasebo, Japan eProject No. 1559827

SECTION 01 14 00.00 33 Page 3 addresses and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.
1.5.1.2 Vehicle List
Submit an original list of vehicles to be utilized at the work site with the following information for each vehicle:
a. Make
b. Year
c. Model
d. License number
e. Registered owner
f. Current BASE pass expiration date.
1.5.1.3 Identification Badges
Identification badges will be issued to the Contractor and his employees in accordance with the Commander Fleet Activities Sasebo Security Regulations.
A copy of the security regulations may be obtained from the security office.
All badges must be returned or accounted for to the department of Public Safety's Pass and Identification Office upon expiration of the badge or contract, or termination of the employee.
1.5.1.4 No Smoking Policy
Smoking is prohibited within and outside of all buildings on installations under the cognizance of the Government except in designated smoking areas.
This applies to existing buildings, buildings under construction and buildings under renovation. Discarding tobacco materials other than into designated tobacco receptacles is considered littering and is subject to fines. The Contracting Officer will identify designated smoking areas.
1.5.2 Shipyard Regulations
Ensure that Contractor personnel employed on the Shipyard become familiar with and obey Shipyard regulations. Do not enter any restricted areas unless required to do so and until cleared for such entry. The Contractor's equipment must be conspicuously marked for identification. Comply with the following conditions:
a. Restrict employees/representatives to the work site and control travel directly to and from the work site.
b. Entry into the dry-dock: Entry into the dry-dock requires notification and approval by the Dock Master via the Contracting Officer.
c. Restore all traffic/parking/security signs and markings, including space numbers, designations, and lines, to their original form if such signs/markings are defaced or deleted during construction/repair.

d. Be responsible for control and security of Contractor-owned equipment and materials at the work site. Report immediately missing/lost/stolen property to the Contracting Officer as each case occurs.
e. Vehicle Speed Limits: The speed limits of all vehicles on the pier must be 15 kilometers or less per an hour.
f. Pier Access Request: The Contractor must submit “Pire Access Request” to the Government, 5 working days prior to start the work.
1.5.3 Working Hours
The project site will be available during regular working hours established by the Contracting Officer between 8:00 a.m. and 4:45 p.m., Monday through Friday, excluding all U.S. legal holidays.
1.5.4 Work Outside Regular Hours
Work outside regular working hours requires Contracting Officer approval.
If the Contractor desires to carry on work outside regular hours, including Saturdays, Sundays, and Government holidays, submit a written justification giving the benefit to the Government, specific dates, hours, location, type of work to be performed, contract number and project title for approval, and submit request outside regular hours 96 hours in advance of the date the work will start. During periods of darkness, light the different parts of the work in an approved manner. All work outside of regular hours is subject to approval by the Contracting Officer. All work outside of regular hours must be able to demonstrate a benefit to the Government. The Contractor must attach a Safety Brief and the Activity Hazard Analysis (AHA) for work that will be done outside regular working hours. The Safety Brief will be signed by the employees performing the work and submitted to the Government’s Representative.
1.5.5 Exclusionary Period
The Contractor must not perform on-site work during an Exclusionary Time Period (ETP) estimated to be between a minimum of 21 calendar days to a maximum of 90 calendar days. The maximum ETP has been considered in computing the time allowed for the performance of this contract.
1.5.6 Occupied and Existing Buildings
a. The Contractor must be working around existing buildings that are occupied. Do not enter the buildings without prior approval of the Contracting Officer.
b. Do not interrupt the Government operation in areas where the Contractor does not perform the work. Provide temporary protections and enclosure for secure safety and convenience. Provide watch man to secure occupancy safety during construction.
c. Minimize parking outages. Requests for parking outages must be made in writing to the Contracting Officer at least 15 calendar days in advance of the time required.
d. Interruption to toilet usage during construction: Toilet in occupied area must be available to building occupants, excluding the approved

SECTION 01 14 00.00 33 Page 5 interruption period. Provide temporary toilet for interruption period as specified in Section 01 50 00.00 33 “Temporary Facilities and Controls”.
e. Construction smell, such as paint, adhesive, asphalt, or chemicals, must be controlled to prevent emission to occupied area.
f. The Government will remove and relocate other Government property in the areas scheduled to receive work.
1.5.7 Utility Cutovers and Interruptions
This project will not permit interruptions to utility services and the Government’s regular operations, except the following item[s] and restriction items specified herein before;
a. The Government will allow to the Contractor the utility cutovers and interruptions after normal working hours or on Saturdays, Sundays, and Government holidays. Conform to procedures required in the paragraph "Work Outside Regular Hours." [In the morning of weekday, all utilities in the building must be available to the Government for use.]
b. Ensure that new utility lines are complete, except for the connection, before interrupting existing service.
c. Interruption to water, sanitary sewer, storm sewer, telephone service, electric service, air conditioning, heating, fire alarm, and compressed air must be considered utility cutovers pursuant to the paragraph entitled "Work Outside Regular Hours."
d. Limit such interruption to sewage service to five (5) consecutive hours between 11 p.m. and 4 a.m. during this project. This time limit includes time for deactivation and reactivation.
e. Limit interruption to electrical service to two times of nine consecutive hours between 9 p.m. and 6 a.m. This time limit includes time for deactivation and reactivation.
f. Provide one temporary generator outside electrical room for fire pump operation during interruption period. For temporary generator take necessary measures to operate them under the direction of the Contracting Officer.
g. The Government will allow to the Contractor interruption of sprinkler service within the outside regular working hours (after regular working hours and on Saturdays, Sundays, and Government holidays) for sprinkler flange gasket work. Conform to procedures required in the paragraph "Work Outside Regular Hours." Provide Fire-Watch-Man during the interruption period.
h. The Government will allow to the Contractor interruption of HVAC service to occupied areas within the outside regular working hours (after regular working hours and on Saturdays, Sundays, and Government holidays). Conform to procedures required in the paragraph "Work Outside Regular Hours."
i. Operation of Station Utilities: The Contractor must not operate nor disturb the setting of control devices in the station utilities system, COMFLEACT Sasebo, Japan eProject No. 1559827

SECTION 01 14 00.00 33 Page 6 including water, sewer, electrical, and steam services. The Government will operate the control devices as required for normal conduct of the work or permit such operation to the Contractor. The Contractor must notify the Contracting Officer giving reasonable advance notice when such operation is required.
1.5.8 Restrictions on Equipment
1.5.8.1 Restrictions on Radio Transmitter Equipment
Conform to the restrictions and procedures for the use of radio transmitting equipment, as directed. Do not use transmitters without prior approval.
1.5.8.2 Prohibition of Radiographic Operations on NAVFAC Projects
No radiographic operations including radiographical tests are allowed on NAVFAC projects. This includes machine and equipment that produce ionizing radiation such as industrial x-ray machines, particle accelerators, electron microscopes, laboratory analytical devices, and all other equipment capable of producing ionizing radiation.
1.5.8.3 Location of Underground Utilities
Obtain digging permits prior to start of excavation by contacting the Contracting Officer 15 calendar days in advance. Scan the construction site with electromagnetic or sonic equipment and mark the surface of the ground or paved surface where existing underground utilities or utilities encased in pier structures are discovered. Verify the elevations of existing piping, utilities, and any type of underground or encased obstruction not indicated to be specified or removed but indicated or discovered during scanning in locations to be traversed by piping, ducts, and other work to be conducted or installed.
a. Notification and Permission Prior to Excavation: The Contractor must request written permission from the Contracting Officer whenever digging is required to perform this contract. The request will provide a sketch of the area, limits of the excavation and expected depths. Any unforeseen discovery of soils suspected of being contaminated with oil or other hazardous materials must be handled and reported as required by Section 01 35 26.00 33 “GOVERNMENTAL SAFETY REQUIREMENTS” Paragraph “Unforeseen Hazardous Material”, in addition, after notifying the Contracting Officer, the Contractor must also notify the Station Environment Office and must, at no additional cost to government, take reasonable measures to protect the excavation form erosion and prevent the spread of suspected contaminants until testing can be accomplished.
1.6 SECURITY REQUIREMENTS
Contract Clause "FAR 52.204-2, Security Requirements and Alternate II," "FAC 5252.236-9301, Special Working Conditions and Entry to Work Area," and the following apply:
1.6.1 Areas Not Covered by Contract
Contractor personnel will not be permitted to enter Shipyard buildings, spaces, and areas not covered by this contract except on prior approval of

Coordinate action with the Contracting officer to obtain such entry approval.
1.6.2 Access to Unclassified Information
Access to unclassified U.S. Navy ship building, conversion, or repair technology and related technical information manuals, documents, drawings, plans, specifications, and other unclassified information is restricted to official need-to-know basis, designated by physical markings to show the appropriate control designations. Handle, control, and safeguard to prevent oral, visual, and documentary disclosure to the public, to foreign sources, and to personnel not having an official need-to-know. Return this information to the naval Shipyard upon completion of contracted work, except when specific retention authorization is granted by the Contracting Officer's Security Representative.
1.6.3 Photographs
Unofficial photograph is prohibited in the Naval Shipyard. When operationally required, submit a written request containing specific justification and details to the Security Officer prior to release.
1.6.4 Employee List for High Restricted Area
A list of all employees to be engaged in the performance of work must be furnished to the Security Department.
1.7 FORCE PROTECTION
All vehicles, hand carried items, and persons are subject to searches upon entering and/or exiting U.S. Military installations and at any time while on the U.S. military installations. Random searches are conducted at all gates, during increased security or force protection conditions (FPCONs).
1.8 TRAFFIC CONTROL
As specified in Section 01 50 00.00 33 “TEMPORARY FACILITIES AND CONTROLS”.

1.3 EARNED VALUE REPORT
1.3.1 Data Required
This contract requires the use of a cost-loaded Network Analysis Schedule (NAS). The information required for the Schedule of Prices will be entered as an integral part of the Network Analysis Schedule. Within 15 calendar days of notice of award, prepare and deliver to the Contracting Officer an Earned Value Report (construction contract) as directed by the Contracting Officer. Provide a detailed breakdown of the contract price, giving quantities for each of the various kinds of work, unit prices, and extended prices. Costs must be summarized and totals provided for each construction category.
1.3.2 Schedule Instructions
Payments will not be made until the Earned Value Report from the cost-loaded NAS has been submitted to and accepted by the Contracting Officer. Identify the cost for site work and include incidental work to the 1.5 m (5 ft) line.

a. Primary Facility/s Cost Breakdown:
Defined as work on the primary facility/s out to the 1.5 m (5 foot) line.
Work out to the 1.5 m (5 foot) line must include construction encompassed within a theoretical line 1.5 m (5 foot) from the face of exterior walls and must include attendant construction, such as pad mounted HVAC equipment, that may extend beyond the 1.5 m (5 foot) line.
(1) Provide a cost breakout for all Primary Facility features that support Low Impact Development (LID), such as vegetated roof and rainwater harvesting features. The sum of the Primary Facility Cost above - a. and these Primary Facility LID sub-items - (1) must equal the total Primary Facility cost. Provide a subtotal cost of all Primary Facility LID sub-items on the Earned Value Report at design complete and project closeout.
b. Supporting Facilities Cost Breakdown:
Defined as site work, including incidental work, outside the 1.5 m (5 foot) line.
(1) Provide a cost breakout for all Supporting Facilities features that support LID, such as bioswales, permeable paving, infiltration basins, tree box filters, etc. The sum of the Supporting Facilities Cost above
- b. and these Supporting Facilities LID sub-items - (1) must equal the total Supporting Facilities cost. Provide a subtotal cost of all Supporting Facilities LID sub-items on the Earned Value Report at design complete and project closeout.
1.3.4 Schedule Requirements for HVAC TAB
The field work Section 23 05 93.00 33 TESTING, ADJUSTING, AND BALANCING OF HVAC SYSTEMS must be broken down in the Earned Value Report from the cost-loaded NAS by separate line items which reflect measurable deliverables.
Specific payment percentages for each line item must be determined on a case by case basis for each contract. The line items must be as follows:
a. Approval of Design Review Report: The TABS Agency is required to conduct a review of the project plans and specifications to identify any feature, or the lack thereof, that would preclude successful testing and balancing of the project HVAC systems. The resulting findings must be submitted to the Government to allow correction of the design. The progress payment must be issued after review and approval of the report.
b. Approval of the pre-field engineering report: The TABS Agency submits a report which outlines the scope of field work. The report must contain details of what systems will be tested, procedures to be used, sample report forms for reporting test results and a quality control checklist of work items that must be completed before TABS field work commences.
c. Season I field work: Incremental payments are issued as the TABS field work progresses. The TABS Agency mobilizes to the project site and executes the field work as outlined in the pre-field engineering report.

The HVAC water and air systems are balanced and operational data must be collected for one seasonal condition (either summer or winter depending on project timing).
d. Approval of Season I report: On completion of the Season I field work, the data is compiled into a report and submitted to the Government. The report is reviewed, and approved, after ensuring compliance with the pre-field engineering report scope of work.
e. Completion of Season I field QA check: Contract QC and Government representatives meet the TABS Agency at the jobsite to retest portions of the systems reported in the Season I report. The purpose of these tests are to validate the accuracy and completeness of the previously submitted Season I report.
f. Approval of Season II report: The TABS Agency completes all Season II field work, which is normally comprised mainly of taking heat transfer temperature readings, in the season opposite of that under which Season I performance data was compiled. This data must be compiled into a report and submitted to the Government. On completion of submittal review to ensure compliance with the pre-field engineering report scope, progress payment is issued. Progress payment is less than that issued for the Season I report since most of the water and air balancing work effort is completed under Season I.
1.4 CONTRACT MODIFICATIONS
In conjunction with the Contract Clause "DFARS 252.236-7000, Modification Proposals-Price Breakdown," and where actual ownership and operating costs of construction equipment cannot be determined from Contractor accounting records, equipment use rates must be based upon the applicable provisions of the EP-1110-1-8.
1.5 CONTRACTOR'S INVOICE AND CONTRACT PERFORMANCE STATEMENT
1.5.1 Content of Invoice
Requests for payment will be processed in accordance with the Contract Clause FAR 52.232-27, Prompt Payment Construction Contracts and FAR 52.232-5, Payments Under Fixed-Price Construction Contracts. The Requests for payment must include the documents listed below:
a. The Contractor's invoice, on NAVFAC Form 7300/30 furnished by the Government, showing in summary form, the basis for arriving at the amount of the invoice. Form 7300/30 must include certification by Quality Control (QC) Manager as required by the contract.
b. The Earned Value Report from the cost-loaded NAS, showing in detail: the estimated cost, percentage of completion, and value of completed performance for each of the construction categories stated in this contract.
c. Contract Performance Statement
d. Updated Project Schedule and reports required by the contract
e. Contractor Safety Self Evaluation Checklist

h. Invoices not completed in accordance with contract requirements will be returned to the Contractor for correction of the deficiencies.
1.5.2 Submission of Invoices
Submit invoices in accordance with the Contract Clauses “DFARS 252.232-7003 Electronic Submission of Payment Requests and Receiving Reports” and “DFARS 252.232-7006 Wide Area Workflow Payment Instructions”. The documents listed in paragraph titled "Content of Invoice" above must be provided in their entirety as an attachment in Wide Area Work Flow (WAWF) for each invoice submitted. The maximum size of each WAWF attachment is two megabytes, but there are no limits on the number of attachments. If a document cannot be attached in WAWF due to system or size restriction it must be provided as instructed by the Contracting Officer.
1.5.3 Content of Invoice
The Contractor's request for progress payments will be processed in accordance with the Contract Clauses “52.232-5 Payments Under Fixed-Price Construction Contracts” and "52.232-27, Prompt Payment Construction Contracts." The contractor must submit payment request through Wide Area Workflow (WAWF) in accordance with Contract Clauses "252.232-7003 Electronic Submission of Payment Requests and Receiving Reports" and "252.232-7006 Wide Area Workflow Payment Instructions" and provide the following documents with submission:
a. Attach the following documents for all invoices:
• Contract Performance Statement form (NAVFAC 7300/31)
• Contractor Certification of FAR 52.232-5(c)
• CQC Certification
• Contractor Safety Self Evaluation Checklist
• Construction and equipment delivery schedules
b. One (1) copy of “Receipt of Bond Payment” for the First Invoice.
c. One (1) original copy of “Final Release Form” and “Transportation of Supplies by Sea Certification” for the Final Invoice.
1.5.4 Invoice Frequency
Contractors are encouraged to invoice monthly for all work completed in accordance with contract requirements during the preceding month.
First/Final invoices should only be utilized when the job size is sufficiently small that multiple invoicing must be construed to conflict with paragraph 1.6, “PAYMENT TO THE CONTRACTOR”, or its subparagraphs
1.5.5 Final Invoice
a. A final invoice must be accompanied by the certification required by DFARS 252.247.7023 TRANSPORTATION OF SUPPLIES BY SEA, and the Contractor's Final Release. If the Contractor is incorporated, the Final

Release must contain the corporate seal. An officer of the corporation must sign and the corporate secretary must certify the Final Release.
b. For final invoices being submitted via WAWF or as instructed by the Contracting Officer, the original Contractor's Final Release Form and required certification of Transportation of Supplies by Sea must be provided directly to the respective Contracting Officer prior to submission of the final invoice. Once receipt of the original Final Release Form and required certification of Transportation of Supplies by Sea has been confirmed by the Contracting Officer, the Contractor must then submit final invoice and attach a copy of the Final Release Form and required certification of Transportation of Supplies by Sea in WAWF or as instructed by the Contracting Officer.
c. Final invoices not accompanied by the Contractor's Final Release and required certification…
