About this file
This is a narrative response attachment for Request for Offer (RFO) 25-1025 issued by the State of California. The document serves as an instruction template requiring respondents to complete specific line items addressing state requirements and bidder qualifications. The primary focus centers on generative artificial intelligence (GenAI) disclosure requirements, mandating that bidders notify the State in writing if they intend to provide GenAI as a deliverable or utilize GenAI, including third-party GenAI systems, to complete deliverables that materially impact state system functionality, risk exposure, or contract performance. Failure to disclose GenAI usage may result in bid disqualification, and the State reserves the right to incorporate GenAI special provisions into final contracts or reject bids presenting unacceptable risk levels based on Government Code 11549.64 definitions.
The attachment requires respondents to provide their business name, Small Business/Disabled Veteran Business Enterprise certification number, and declaration regarding GenAI utilization through yes or no responses. Additional disclosure requirements include confirmation of whether the respondent conducted business outside the United States within the preceding three years, with affirmative responses triggering submission of the Darfur Contracting Act Form. Respondents must also provide their Secretary of State Business Entity Number as part of the standard information submission requirements.

NARRATIVE RESPONSE
Instructions: Respondent must complete each line item outlined below:
RESPONDENT NAME: SB/DVBE Cert. #
NARRATIVE QUESTIONS:
1. GENERATIVE ARTIFICIAL INTELLIGENCE (GenAI) REQUIREMENTS
The State of California seeks to realize the potential benefits of GenAI, through the development and deployment of GenAI, while balancing the risks of these technologies.
Bidder must notify the State in writing if it:
1. Intends to provide GenAI as a deliverable to the State; or
2. Intends to utilize GenAi, including GenAI from third parties, to complete all or a portion of any deliverable that materially impacts:
- Functionality of a State system,
- Risk to the State, or
- Contract performance. For avoidance of doubt, the term “materially impacts” shall have the meaning set forth in State Administrative Manual (SAM) 4986.2
Failure to report GenAI to the State may result in disqualification. The State reserves the right to seek any and all relief it may be entitled to as a result of such non-disclosure. Upon notification by a Bidder of GenAI as required, the State reserves the right to incorporate GenAI Special Provision into the final contract or reject bids that present an unacceptable level of risk to the State.
Government Code 11549.64 defines “Generative Artificial Intelligence” (GenAI) as an artificial intelligence system that can generate derived synthetic content, including text, images, video, and audio that emulates that structure and characteristics of the system’s training data.
