RFO 25-1024: Investigation Management System Improvements

This is a Statement of Work and consulting services agreement issued by the California Office of Energy Infrastructure Safety (Energy Safety) for improvements to the Investigation Management System used by the Underground Safety Board's enforcement division. The project requires the contractor to provide four key consulting staff members—a Project Manager, Business Solutions Analyst, User Experience/Interaction Designer, and Senior Software Engineer—to configure a Software as a Service (SaaS) enforcement management solution. The contractor must develop and configure a system built on Microsoft technologies, specifically Dynamics 365 and Power Platform, to replace deficiencies in the current DigCase system. The scope of work encompasses discovery and documentation of current processes, development of a Task Accomplishment Plan, configuration of databases and workflows, creation of user interfaces for internal stakeholders (Board members, attorneys, and clerks), development of external portals for respondents and referral agencies, creation of dashboards and alerts, development of document templates and reports, establishment of public-facing dashboards, and delivery of training materials and a final project report. The contract term extends for 24 months from the effective date, with Energy Safety retaining the option to extend the agreement for two additional 12-month periods at the original evaluated rates.

The contract is structured as an hourly-based consulting agreement with a maximum cost not to exceed $1,500,000. Payment will be made monthly in arrears upon Energy Safety's acceptance of completed deliverables, with invoices submitted according to work authorization approvals. The contractor bears all responsibility for travel, per diem, and compliance with health and safety mandates. The contract incorporates the Department of General Services Technology, Digital and Data Consulting (TDDC) Master Service Agreement terms and conditions and is subject to California Budget Act appropriations; should funding be reduced or eliminated, Energy Safety may cancel the contract without liability. All work products and data developed under this agreement become the property of Energy Safety. The contractor must maintain all personnel qualifications throughout the contract term, obtain prior written approval for any personnel substitutions, and comply with confidentiality and conflict-of-interest provisions, particularly regarding relationships with investor-owned utilities and related entities.

EXHIBIT A

STATEMENT OF WORK

1. OBJECTIVE

TBD Contractor (hereafter referred to as Contractor) must provide the Office of Energy Infrastructure Safety (Energy Safety) one Project Manager (PM), one Business Solutions Analyst (BSA), one User Experience/Interaction Designer (UX/ID) and one Senior Software Engineer (SRSE) to configure a Software as a Service (SaaS) enforcement management solution for the Investigation Management System which is utilized for the Underground Safety Board’s enforcement actions.

2. BACKGROUND

Energy Safety is procuring information technology (IT) consulting services to support the Underground Safety Board (Board). Energy Safety desires an information technology management solution that allows the different users in the enforcement process, such as Board members, the Board’s attorney, and the clerk, to view the status of Notice of Probable Violations (NOPV) and to easily manage their information. Energy Safety currently has an investigations case management system (DigCase), which is a Dynamics 365-based model-driven application that connects to a SharePoint environment for document storage. DigCase is used primarily by investigators prior to the issuance of an NOPV. DigCase currently uses Dataverse tables to manage some enforcement related information, but it lacks appropriate user interfaces, dashboards, and workflows to effectively manage the Board’s enforcement process and support investigators. A solution consistent with this solicitation would develop these tools to account for the different user base and processes but share existing Dataverse tables with DigCase.

3. TERM OF PERFORMANCE

The term of this Agreement is upon approval (Effective Date) through 24 months. Energy Safety, at its sole option, may amend the original Agreement to add funds and/or to extend the term for two additional options, each for a period of twelve months at the original rates evaluated and considered as indicated in Exhibit B- 1, Cost Worksheet.

The Contractor must not be authorized to performance of services described in this Agreement prior to the effective date. Energy Safety will not provide compensation to the Contractor for any delivery of goods or performance of services commenced prior to the effective date.

4. CONTRACT REPRESENTATIVES

Any changes in Contractor’s Project Representative must be immediately reported in writing to Energy Safety. Energy Safety reserves the right to identify an Energy Safety Designated Representative in the absence of the Energy Safety Contract Manager or Designated Representative.

Deliverable acceptance documented in the agreed upon Work Authorization (WA) approval. The WA documents the work the Consultant staff will complete with respect to the services, tasks, deliverable or deliverables. The WA is developed after discussion between Consultant staff and the Energy Safety Contract Manager, and each agrees to the Consultant staff workload and tasks to complete the deliverable. It is Energy Safety’s sole determination as to whether a project deliverable identified in this Agreement and in a WA has been successfully completed and is acceptable to Energy Safety. Acceptance criteria consist of the following:

A. The approval process outlined in WA Process (Section 11).

B. The Contractor meeting all timelines, as agreed to in the Agreement or in a WA (Exhibit A-1), as approved by Energy Safety’s Contract Manager.

F. Energy Safety has the right to require the Contractor to stop or suspend work on any WA.

G. The WA documents the time associated for Consultant staff to complete services or tasks. Energy Safety will only pay for the time associated and documented in the signed WA. Consultant staff must not be expend or work beyond the hours identified in the approved WA unless the procedure below is followed:

1. If, in performance of the work, the Consultant determines that a WA to be performed under this

13. PROBLEM ESCALATION

The parties acknowledge and agree that certain technical and project related problems or issues may arise, and that such matters must be brought to Energy Safety’s attention. Problems or issues must normally be reported in regular status reports. When problems arise, the Contractor first should discuss the issue with the Energy Safety Contract Manager and work towards resolution. There may be instances, however, where the severity of the problems justifies escalated reporting which is to be determined by the Energy Safety Contract Manager who will escalate as necessary, following internal Energy Safety communications. In instances when the Energy Safety Contract Manager is non-responsive or unable to resolve the problem, the Contractor may notify the appropriate Energy Safety personnel as follows:
