Industry Meeting/Pre-Proposal Meeting MTDC - Missoula, Montana

June 3, 2008 Welcome

• Sign-in & Introductions

Background and Purpose of Indefinite Delivery Indefinite Quantity (IDIQ) Contract

• The contracts awarded as a result of this solicitation (estimated to be between four and seven) will enable the Western Montana Acquisition Zone to be more responsive to the needs of the individual units in meeting their procurement needs. The budgets usually aren’t finalized until May which is almost too late to advertise and award contracts before the end of the fiscal year.

• Once the parent contracts are awarded as a result of this solicitation, individual task orders can be awarded within 7 to 10 days from the receipt of the unit’s request.

Review Highlights of Solicitation and Attachments

Request for Proposal (RFP)

• The solicitation is 100% set-aside for HUBZone Businesses HUBZone Businesses are approved by the Small Business Administration (SBA).

Company must be SBA approved and appear on the Certified List of HUBZone

Businesses and registered in CCR and ORCA as HUBZone Businesses at the time the solicitation closes.

The Contacts and Links included on page 4 will assist Contractors to verify if they qualify for HUBZone status and in getting registered.

• A Bid Bond is not required for the solicitation; however, individual task orders may require bonding.

Performance and/or Payment Bond amounts will be noted in the order.

• Solicitation was posted to FedBizOpps 5/30/08.

• Parts of the solicitation include: Short Set of the solicitation (this is the part that will be submitted as your offer), the complete solicitation package (retain this for your records), Attachment A (includes the Wage Rates, Minimum Impact Guidelines, Food Storage Requirements, and the Special Project Specifications), Attachment B (includes the standard drawings), Project 1 Canyon Creek/Canyon Lake Trail (submit schedule of prices with your offer), and Project 2 Rombo, Parts 1 and 2 (submit schedule of prices with your offer).

FedBizOpps website (fbo.gov) has changed, the best way to get to the advertisement is to enter the solicitation number. Call Barbara Venturini at (406) 758-5318 if you have any questions on accessing the solicitation.

• Proposals are due 6/30/08 by 4:00 p.m. local time (Mountain Daylight Time). All proposals are to be returned to the Western Montana Acquisition Zone main office at Building 24 – Fort Missoula, Missoula, MT 59804 and will not be accepted at the individual Forest offices.

Amendment No. 01, Page 03 of 08

• Schedule of Items Priced items shall be based on the specifications. Measurements are +/- 15% for the majority of trail work. If task order requirements exceed these specifications by more than 15% an adjustment will be agreed to before the task order is issued.

Priced items shall be based on the Davis Bacon Wage Decision in the solicitation. The primary Wage Decision to be used is for Montana, use Zone 2.

Idaho Wage Decision is incorporated by reference. If work is ordered to be performed in Idaho the wages will be compared to determine if an adjustment is needed. Do not use this wage decision to price the items in the Schedule of Items.

Some items will be negotiated when task order is issued. The reason is that there are no standards or averages that can be defined until the work is surveyed, staked, and specified.

Delivery and Contract Time

• Contract Time for the Base Period will be from date of award (estimated to be July) through March 31, 2009. If Option Periods are exercised they will be for 1 year each. Total Contract Time will not exceed 3 years.

• Delivery will be agreed to on the individual task orders. Clauses in Section F have been left blank. The schedule agreed to on the task order will become the delivery time for that order only.

Camping, Stock Use, Leave No Trace, Minimum Impact Guidelines, and Food Storage

• Special Order are all applicable to work performed under these contracts. See Section H and Attachment A.

Drawings

• The Drawings included in Attachment B contain the most common measurements; i.e. clearing limits, rolling dips, etc. These Drawings are in agreement with the three Forests. Individual Projects issued under the contract may have the same drawings contained in the solicitation or have drawings pertinent to those projects. Project 1 - Canyon Creek/Canyon Lake Trail and Project 2 - Rombo Trail have the same drawings contained in the solicitation.

Specifications

• Standard Specifications for Construction of Trails (September 1996) are included in the solicitation by reference. Contractors will need this specification book. Copies of this publication can obtained from the Government Printing Office, P.O. Box 371954, Pittsburgh, PA 15250-7954; telephone

(202) 512-1800, Stock Number – 001-001-00661-1, Publication #EM-7720-103.

• If the individual projects need to supplement the standard specifications, the supplemental specifications will be included with the project information. If not supplemented, the standard specification governs.

• We will not use metric measurement in these projects. All work will be in standard measurements.

Proposal

• Section L outlines what the Offeror is required to provide as part of their offer. There are three parts to the proposal – Past Performance and Experience; Technical; and Business. Each part must be addressed as instructed.

Amendment No. 01, Page 04 of 08

• The Business proposal includes the schedule pricing, and pricing for Projects 1 and 2. These projects will be awarded as task orders once the parent contracts have been awarded.

Awards

• Based on most advantageous to the Government, estimating four to seven awards will be made.

• See Sections L & M of Solicitation.

• Guarantee is $5,000 per contract per year. Maintenance type work can be used to meet the guarantee.

• Maximum Contract Amount is $300,000 over the life of the contract (Base plus 2 Option Years)

Orders

• Task orders may be placed by any Contracting Officer assigned to the Western Montanan Acquisition Zone.

• Work to be performed on the Bitterroot, Lolo, or Flathead Forests only (i.e. no other Forest or Region can order work under these contracts).

• Primary purpose is for trail construction and reconstruction, maintenance work may be ordered under these contracts.

Ordering and Ordering Limitations

• Section I defines ordering and the ordering process that will be used by the Government.

• Order Limitations are also in Section I. The Contractor is required to perform work within these limitations.

• Orders outside these limitations can be offered to the Contractor but they have the right to not accept the order.

• The Limitations are:

Minimum Order $5,000 Maximum Order $65,000 or a Combination of Orders in excess of $100,000

Amendment No. 01, Page 05 of 08

QUESTIONS AND ANSWERS

1. Question: Will all contracts be going through these IDIQ Contracts?

Answer: Not all trail projects on the three Forests but probably most of them. This process allows us to quickly respond to circumstances that affect the resources such as weather, fire, etc. It will also allow the Government to award projects if funding arrives too late in the year to compete work using FedBizOpps.

Additional Information: These contracts will be used for construction and reconstruction to the fullest extent possible. When the contracts are maxed out, solicitations may be issued for individual projects.

Maintenance work may be solicited separately.

2. Question: I have concerns that all work will be needed at one time. Will the scheduling for the individual projects be a negotiated item?

Answer: The orders will include a description of the work, special project specifications (not included in the parent contract), trail logs, and drawings to supplement the parent contract. It will also include a normal operating time that work can be accomplished at the site (depending on snowpack, elevation, and environmental or wildlife restrictions). We will ask you to give us a price and a delivery schedule.

3. Question: In the Schedules of the individual Projects (Canyon Creek and Rombo) you state that certain items identified with an asterisk are pre-priced items. What is the amount of the pre-priced item?

Answer: The unit prices for those items must match the unit price you submitted as your offer in the solicitation. Example: The unit price for Item 911(10) for Project 1 Canyon Creek must match the unit price for Item 911(10) in the solicitation.

4. Question: What if you’re not able to take on either of the two projects (Canyon Creek or Rombo)? Do we have to submit an offer?

Answer: Priority is to award the parent contracts. When a schedule of items such as the one in the solicitation is used, a price evaluation table is used to calculate price. We did not insert such a schedule as these project will be used in lieu of an evaluation table. So yes, these projects need to be priced as part of the offer.

Additional Information: These projects have to be completed this year so if an offeror cannot accept these projects they still need to price them. However, a notation on the project schedule stating they are not able to complete the work this season may be added. This way the Government still has a way to evaluate prices of all offers fairly, but will not award the Canyon Creek or Rombo to companies that are unable to perform the work this season.

5. Question: Once you establish your price pool of Contractors, will the “low price” Contractors get most of the work?

Answer: We’ll use best value awards. What that means is we’ll look at location of the work compared to location of the Contractor (less mobilization costs for both parties), whether the work is in the wilderness or not, and how much work does the Contractor currently have. As always, best value includes reasonable price.

Amendment No. 01, Page 06 of 08

Additional Information: Periodically the Contracting Officer will review the projects that have been awarded to this pool of Contractor. If necessary an adjustment to how the projects are awarded will be made to try and have a fair distribution of the work. Special consideration will be applied to avoid exceeding a company’s bonding capacity.

6. Question: Project 1 Canyon Creek seems to include maintenance work. Do we have to price this work under the Davis Bacon Act wages?

Answer: The solicitation and subsequent contract award are governed by the Davis Bacon Act. All task orders awarded under the parent contracts must include the Davis Bacon Act Wages.

7. Question: I’m confused by the HUBZone certification, once you’re certified as a HUBZone Concern can you work in other HUBZones?

Answer: Once certified, you can bid on any HUBZone Set-Aside projects.

Additional Information: A HUBZone Business is a status granted by the Small Business Administration based on certain factors. Business size, office location, employee addresses, etc. are used to determine if a company is qualified. This status belongs to the company regardless of where the contract worksite is performed.

8. Question: Can HUBZone Contractors also bid on regular contracts?

Answer: Yes. Even if not competing for work that has been set-aside for HUBZone, the Government tracks the types of businesses awards are made to and this information will be included in their reports. Be sure CCR and ORCA are current and accurately reflect business status.

9. Question: Can a HUBZone and a Small Business Contractor submit an offer as a joint venture?

Answer: The Joint Venture itself must be a HUBZone Concern. You’ll need a new DUNS number and new registration. Fifty-one percent of the business must be HUBZone. Refer to the Small Business Administration and your local Procurement Technical Assistance Center for assistance.

10. Question: How will we find out about new projects?

Answer: We could e-mail or send via certified mail. It all depends on the project.

11. Question: Once the pool of Contractors is established and a certain Contractor can’t do the project, how will you proceed to the next Contractor?

Answer: Contracting Officer Sue Beron will handle all orders for work this year. She will try to balance work this first year. Next year all Western Montana Acquisition Zone warranted Contracting Officers will be able to place orders. Best value and bonding limitations will come into effect in award determinations.

12. Question: Will a Contractor be allowed to decline a project?

Answer: Not if the dollar amount is within the Ordering Limitations outlined in the contract.

13. Question: What is there is a conflict of work? Can we turn down the project then?

Answer: Basically the orders within the Ordering Limitations requires the Contractor to perform the work.

Keep us informed as to work you have on other units so that we can avoid this situation as much as possible.

Amendment No. 01, Page 07 of 08

14. Question: What if we’re out on a project and are not available to respond within 5 days of receipt of certified mail (Section I- 4) to an order exceeding the maximum order. Are we bound to perform the work?

Answer: If the Contractor is the one checking their mail, then they should be able to respond within the 5 days of receipt. If the Contractor is having another person check the mail while they are on projects, then the person checking the mail needs to contact them to meet the response time. Most firms have access to electronic devices that allow contact with home units. Contracting Officer will evaluate this clause to ensure it’s accurateness. Example: If you receive two orders within 14 days, you can decline an order.

You’ll need to contact us within 5 days of receiving these orders to let us know which one you’ll be declining.
