About this file

This document is Addendum #2 for Agency Solicitation Number ARFQ DEP2500000073, issued by the West Virginia Department of Environmental Protection's Division of Land Restoration and Office of Special Reclamation. The addendum extends the bid closing date from 6/26/25 to 7/2/25 and includes vendor questions and responses, as well as some drawing revisions. The solicitation appears to be for a project involving pond and sludge cell construction, access road upgrades, and related infrastructure work at a mining site in Boone County, West Virginia.

The estimated project cost is $344,113, and the addendum provides clarifications on various project details, including access road construction, sludge removal lines, road maintenance, pond dewatering, and material handling. Key points include using 6-inch HDPE SDR 11 pipes, upgrading existing access roads with specific layering requirements, and converting Pond No. 2 into a sludge cell. The contractor will be responsible for establishing survey control, installing sediment silt fencing, and following state wage requirements. Remaining road maintenance funds will be deducted in the final change order if not fully utilized.

Addendum #3 – Vendor Questions Response

ARFQ DEP2500000073

OSR Asset Mining, LLC - S-5030-95

Q1. It is the plan to install all Access Roads as “New” and using the details shown in the drawings? I know some access roads were existing, but needed repaired or cleared to make them usable again

A1. The plan is to upgrade the two existing access roads as proposed in the plans. The typical details included in the plans show the layers of materials including separation fabric that will be included in the construction of the new road surface.

Q2. Is there a spec on the Sludge Lines #1 and #2 in regard to size/diameter or brand?

A2. On the Piping Plan it says 6 Inch HDPE SDR 11 pipe. No particular brand is specified.

Q3. Regarding “Road Maintenance”… on past projects that we bid, this line item was assigned a total dollar amount to be used…. Is there a dollar amount this time or is it up to the contractor to set that amount that will be needed?

A3. The Road Maintenance line item will be a lump sum bid item. It will be used for any necessary repairs which may need to be made to the existing access road to the site should it begin to deteriorate in a particular area. Any area in question would need to be reviewed and approved by the DEP representative on site.

Q4. If the Contractor “sets” the Road Maintenance amount and it is not needed 100%, will that money that is remaining go to the contractor or is it given as credit back to the owner?

A4. If the full amount is not required, the remaining amount will be deducted in the final change order.

Q5. Is there an Engineer’s Estimate for this project?

A5. The estimated project cost is $344,113.

Q6. Are there any restrictions on how fast Pond No. 2 can be drained?

A6. Pond No. 2 shall be dewatered in a controlled manner which will prevent sediment from being discharged.

Q7. Can Pond No. 2 be breached to dewater it for construction purposes?

A7. The water level shall be lowered initially by pumping. After the initial pumping phase the DEP representative on site will approve the level which breaching may occur in order to prevent ponding of water during construction. If Pond No. 2 is breached for construction purposes, the material removed must be placed back and compacted in

OSR Asset Mining, LLC - S-5030-95 accordance with the Technical Specification 6-5 Unclassified Excavation. The cost to do so will be incidental to the lump sum bid price submitted and will be at no additional cost to DEP.

Q8. Where will the material come from to construct the sludge cell?

A8. The material to construct the sludge cell will be excavated at the site as shown in detail on Sheets 8, 9 and 10.

Q9. Are there existing survey control points?

A9. There are no existing survey control points established. It is the responsibility of the contractor to establish survey control for this project.

Q10. Can the baffles being removed be buried on site?

A10. No, they must be disposed of in the garbage.

Q11. How far down is the material to be removed in Pond 1A?

A11. Down the top surface of the old liner.

Q12. Will the contractor be responsible for water treatment during construction?

A12. The DEP will be responsible for treating water quality parameters included in the NPDES permit. However, the contractor will be responsible for installing and maintaining sediment silt fence.

Q13. Are Davis Bacon wages required?

A13. No

Q14. May pond cleaning material be placed upon the hill (on previously mined area), covered and seeded?

A14. The plan is for Pond No. 2 to be converted into the sludge cell. Any material removed may be placed at the head of Pond No. 2 in the vicinity of the proposed turnaround area shown on the plans. Once the sludge cell has been constructed, any pond cleaning material from Pond No. 1 and 1A will be placed in the constructed cell.

Q15. What are the wage requirements?

A15. The contractor must pay wage rates based upon current state wage requirements.
