About this file
This is Addendum 1 to an Abbreviated Request for Quote (ARFQ) issued by the State of West Virginia for the procurement of a storage container. The solicitation, numbered GSD2700000021, seeks a new or one-trip 40-foot high-cube container with open-side, full-length access for Building 8. The addendum clarifies that containers with four side-opening door panels that collectively provide full-length side access are acceptable alternatives to the specified two-door configuration, provided all other requirements are met, including marine-grade flooring, water-tight condition, lock boxes, roll-off delivery, and a 15-day delivery requirement. The addendum was issued on June 8, 2012, to publish vendor questions and responses and distribute documentation to the vendor community. Bidders were required to acknowledge receipt of all addenda by submitting a completed Addendum Acknowledgment form with their bids, with failure to do so potentially resulting in bid disqualification.
The addendum addresses critical operational and contractual questions from prospective vendors. Notably, the State permits awarded vendors to utilize third-party suppliers and carriers for container delivery while maintaining full responsibility for contract performance and specification compliance. Payments are made exclusively to the awarded vendor, with invoices requiring exact matching to the awarded vendor name to avoid rejection. Out-of-state sole proprietors must complete West Virginia OASIS/Purchasing Division vendor registration and any required Secretary of State or tax registration within three business days of bid opening or face replacement by the next lowest qualified bidder. All provisions of the original solicitation remain in full force and effect except as modified by this addendum.

Q1. The solicitation calls for a new/one-trip 40’ high-cube container with “open side with full length side access” and the detailed requirement is described as two-door, full-length open-side access.
Would a new/one-trip 40’ high-cube FULL OPEN SIDE container using four side-opening door panels be considered an acceptable equal, provided the doors collectively provide full-length side access and the unit otherwise meets every requirement (dimensions, wind/water-tight condition, marine-grade flooring, lock box(es), roll-off delivery, and 15-day delivery requirement)?
A1. That is acceptable.
Q2. May the awarded Vendor use a third-party container supplier/depot and carrier to deliver the compliant Contract Item directly to the State’s Ship-To location, while the awarded Vendor remains fully responsible for contract performance?
A2. Yes.
Q3. The General Terms state payment is made in arrears to the Vendor and that assignment of the Contract or monies requires express written consent. Is supplier-direct invoicing/payment ever permitted for this ARFQ, or must the awarded Vendor invoice the State and then separately pay its supplier?
A3. Payments may only be made to the awarded vendor. The invoice must match the awarded vendor exactly, any discrepancies and the invoice will be rejected and payment will not be made until an invoices corrected.
Q4. For an out-of-state sole proprietor submitting a signed paper bid, must full wvOASIS/Purchasing Division vendor registration and any West Virginia Secretary of State/Tax registration be complete before bid submission on September 22, or may those registrations be completed after bid opening but before contract award?
A4. You may register with the above parties after bid open, but will not be awarded until those registrations are completed. The vendor will have to be fully registered with the State within 3 Business Days from bid open or the Agency will have to move to the next lowest bidder meeting specification. Time is of the essence.
Q5. If ORXYZ submits the bid and is awarded the Contract as the Vendor, may the physical container be shipped/delivered directly to the State’s specified Ship To location by ORXYZ’s supplier or delivery subcontractor, provided that:
ORXYZ remains the awarded Vendor / contract holder;
ORXYZ invoices the State under the awarded purchase order;
the State makes payment only to ORXYZ;
ARFQ GSD2700000021 Building 8; Connex Box for Storage Vendor Technical Questions and Responses
ORXYZ remains fully responsible for specification compliance, the 15-day delivery requirement, risk of loss, warranty/returns and all other contractual obligations;
and the delivered container fully meets every mandatory specification in the solicitation?
A5. Yes.
