RE: Auto Liability
Self-Insured Retention (SIR) Practices for EAN Holdings, LLC
EAN Holdings, LLC, hereinafter referred to as "EAN", is a business with operations in Arizona. Based on its financial condition, EAN utilizes a SIR mechanism as an equivalent to third-party provided insurance for its auto liability risk. Auto liability self-insurance has been approved by MVD via self-insurance application process, and an official MVD issued self-insurance certificate is attached.
Under the SIR, EAN self-insures for these risks at the level and dollar amounts, up to $2 Million, on a per occurrence basis for permitted and non-public use of the State of Arizona's and/or ADOT's right-of-way.
EAN maintains adequate levels of retained earnings or revenue to meet these self-insuring obligations.
EAN is covered under an excess commercial automobile liability insurance policy for losses above the $2 Million SIR. EAN agrees to name ADOT as an additional insured for liabilities caused, in whole or part, by the actions or omissions of EAN on its excess commercial automobile policy and provide a Certificate of Insurance regarding such policy upon request.
EAN agrees to honor its financial responsibility and will not seek recovery in subrogation from ADOT, its officials and/or employees operating vehicles for business purposes, as defined by the parties’ agreement, for all claims, damages, losses, liabilities, or expenses relating to, arising from, for losses arising from work performed by, or on behalf of the Contractor.
