***Verification Testing / Phase 1 (page total not applicable)

Pages that are over the stated maximums will not be evaluated.

Technical Capability shall be separate from the Price Proposal and shall not contain any reference to price.

Phase 1 / Volume IV – Price:

Each offeror shall submit its Volume IV to perform all minimum technical characteristics (MTC) contained in the Statement of Requirements (SOR) using Attachment 3 – Contract Pricing Spreadsheet. Additional price proposal pages in Microsoft Word or other applications may be submitted to support an offeror’s submittal.

The Government estimates, but does not guarantee that a level of effort totaling 588 hours will be required to perform the service portion of the SOR in each contract year. The contract will encompass a base period of one (1) year and three (3) option periods of one (1) year each for a total of 2,352 hours. Offerors may use the Government’s labor hour estimate as a basis for price proposals, or offerors may choose to propose on a different basis. If the proposal is not based on the Government’s estimate, the offeror shall explain in clear terms the rationale for the basis.

Contractor Travel is anticipated during each contract year. Contractor travel will be established each period as a separate line item on a not-to-exceed (NTE) basis. The Contractor shall not adjust travel ceiling amounts on Attachment 3 – Contract Pricing Spreadsheet. The travel ceiling for each contract year is $10,000 (inclusive of G&A).

Phase 2 / ***Verification Testing:

Upon request by the USCG Contracting Officer, an offeror shall provide its proposed Biometric Reader for verification testing. Verification testing may be conducted at a Government site or a Government representative may visit the offeror’s facility. The offeror agrees to not hold the Government liable for any damage that may occur during verification testing.

Volume I shall include a separate cover letter and a separate page containing any exceptions and/or assumptions to the terms and conditions if applicable. The offeror is cautioned that any exceptions and/or erroneous assumptions to the terms and conditions of the solicitation will be at their own risk of being removed from consideration for award. Any exceptions and/or assumptions shall clearly identify the proposal paragraph, term and/or condition to which the exceptions and/or assumptions is taken and include supporting rationale. Any exception to a firm-fixed-price (FFP) contract/order arrangement will result in the Contractor being removed from consideration for award.

The experience shall involve providing Biometric Reader and accompanying support services. Title pages, Table of Contents, Cover sheets, Indexes, Exceptions/Assumptions, response to provisions and clauses are not included in the total page count. Offerors shall complete the specifics of provisions 52.209-7, 52.209-11, 52.212-3 Alt I, 52.222-22, 52.225-18 and HSAR 3052.209-70 and return it as a separate part of your response package titled ‘Provisions and Clause Response’. With respect to provision 52.212-3, place “___N/A___” at the end of section (b)(2) of the provision if the information contained in your current SAM registration applies to this proposal as well. The proposal shall also include the period of its availability from the date of the RFP close date (e.g., 120 calendar days).

FAR 52.212-2 EVALUATION–COMMERCIAL ITEMS (OCT 2014) applies to this acquisition. Addendum to FAR 52.212-2 is FULL TEXT (tailored) as follows:

The basis for award is lowest price technically acceptable. The Government intends to award one (1) firm-fixed-price contract for this requirement. The Government will evaluate proposals only to the extent necessary to identify the lowest priced technically acceptable proposal.

Phase 1 / Price:

After the initial solicitation close date, the Government will review all price proposals to determine which proposal is the lowest price. The Government will not rate or score price, but will analyze proposals in accordance with FAR 15.404-1(b)(2) to determine fair and reasonable prices. The Government may eliminate a proposal from consideration for award as incomplete if an offeror fails to complete the pricing spreadsheet, as instructed. If the proposed level of effort is less or more than the Government’s estimated level of effort, the Government will further assess the rationale and reasonableness of the offeror’s proposed level of effort. The Government will use “Total Proposed Price” (including travel), as calculated from Attachment 3

– Contract Pricing Spreadsheet, when determining the lowest price proposal. The lowest price offeror only will be sent a request for its Biometric Reader to undergo verification testing.

Phase 2 / ***Verification Testing:

The Government will conduct verification testing on the Biometric Reader using the methodology delineated in Attachment 4 – Biometric Reader Verification Process. The Government will evaluate whether the lowest price offeror’s proposed Biometric Reader successfully yields all expected results delineated in the Attachment 4 – Biometric Reader Verification Process. Yielding all expected results equates to “Successful Completion” of verification testing. Failure to yield all expected results equates to an “Unacceptable” verification testing designation. If an offeror is evaluated to be “Unacceptable” at any point during the evaluation process, the next lowest price offeror will be requested to undergo verification testing of its proposed Biometric Reader. The Government will return the Biometric Reader upon completion of verification testing.

Phase 2 / Technical Capability:

The Government will evaluate whether the offeror’s responses to the Attachment 5 – Biometric Reader Evaluation Criteria Questions meet all Technical Evaluation Criteria. Simply responding to some of the questions or only parts of questions would not be sufficient to meet all Technical Evaluation Criteria. Technically acceptable under technical capability means offeror responses to questions on Attachment 5 clearly meet all criteria.

Phase 2 / Volume II – Past Experience:

The Government will evaluate the offeror’s past experience narrative for relevancy. In determining whether past experience narrative is relevant or not relevant, consideration will be given to contracts of similar project complexity, scope, and type. Technically acceptable under past experience means the relevant experience referenced by the offeror involved(es) providing Biometric Reader and accompanying support services.

Phase 2 / Volume III – Past Performance:

The Government will evaluate whether the offeror successfully performed on a contract of similar complexity, scope, and type. Government may ask the Contractor to provide clarifying information regarding problems encountered and the Contractor’s corrective actions on the identified contract. Technically acceptable under past performance means the Government finds no past performance information that suggests the contractor is not recommended for future contracts. The absence of past performance information will be deemed "neutral", which is technically acceptable.

This RFP shall not be considered direction to proceed with the subject effort, nor a promise of future direction to proceed.

The Government intends to evaluate proposals and award a contract without discussions.

Therefore, each initial offer shall contain the offeror’s best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if determined necessary by the Contracting Officer. The Government may reject any or all offers if such action is in the public interest and waive informalities and minor irregularities in offers received.

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

FAR 52.212-3 OFFEROR REPRESENTATIONS AND
