(viii) FAR 52.212-1, Instructions to Offerors – Commercial (OCT 2018), applies to this acquisition. The following addenda apply:
Paragraph (c) is hereby changed from 30 calendar days to 60 calendar days.
Paragraph (h) is removed. The Government intends to make a single award.
(ix) Evaluation - FAR 52.212-2, Evaluation -- Commercial Items (OCT 2014), applies to this acquisition.
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(i) Price – Price will be determined fair and reasonable in accordance with FAR 15.404-1(b)(2);
(ii) Technical - Technical capability of the item offered to meet or exceed the Government requirement;
(iii) Past Performance (see FAR 15.304);
Technical and past performance, when combined, are, in accordance with FAR 15.304, less important, when compared to price. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
Evaluation Methodology:
The LPTA process will proceed as follows:
(1) Proposals may be removed from consideration for any one of the following reasons:
Proposals that are not received timely; Proposals that fail to follow instructions; Proposals that fail to submit any required documentation; Proposals that fail to demonstrate compliance with the specification; Proposals from offerors not registered at the time proposals are due, and/or Proposals that have language inconsistent with the terms and conditions set forth in the solicitation.
(2) Proposals will be ordered by price from lowest to highest.
(3) The Government will then review Factor 2 of the lowest priced proposal. Upon determining that the contractor is technically acceptable, the Government will evaluate Factor 3. Upon determining that the contractor has acceptable past performance, the Government will make a determination of price reasonableness. Contingent upon a subsequent determination of price reasonableness (in accordance with FAR Part 15) and of contractor responsibility by the Contracting Officer, an award will be made to that contractor without further consideration of any other proposals.
If the lowest proposal is determined not to be acceptable for any reason, then the next lowest priced proposal will receive an evaluation as described above. The process will continue (in order by price) until a proposal from a responsible contractor is determined to be acceptable and priced fairly and reasonably.
(4) Using this procedure, the Government might not evaluate all Proposals.
(x) Offerors shall submit completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items (OCT 2018), with its offer.
(xi) FAR 52.212-4, Contract Terms and Conditions -- Commercial Items (OCT 2018), applies to this acquisition. No addenda are attached.
