PART I

SECTION B—SUPPLIES OR SERVICES AND PRICES/COSTS

The Contractor is to provide administrative support services to the U.S. Department of Transportation, Pipeline and Hazardous Materials Safety Administration (PHMSA) at its Headquarters and Regional Offices. The Contractor must furnish all necessary labor necessary to provide the services as set forth in Section C—Statement of Objectives.

B.2 NON-PERSONAL SERVICES IDIQ STATEMENT

This is a non-personal services contract as defined in Federal Acquisition Regulation (FAR) 37.101. The Government will evaluate the quality of support services provided, but the Contractor retains control over its employees or agents. The Contractor is solely responsible for and liable for, and expressly agrees to indemnify the Government with respect to any liability producing acts or omissions by it or by its employees.

B.3 CONTRACT TYPE

PHMSA will enter into an Indefinite Quantity Indefinite Delivery Contract (IDIQ). PHMSA will issue orders against the IDIQ for specific requirements with services priced on a labor-hour or firm fixed-price basis. PHMSA may also issue orders or award specific items on a firm-fixed-price basis.

B.4 TOTAL IDIQ MINIMUM AND CEILING

B.5 ORDERING AND FUNDING

PHMSA will issue orders against the IDIQ for specific support requirements (Contractor personnel requirements). Funding will not be obligated at the parent IDIQ level. All funding will be provided at the Order Item level and will be subject to availability of appropriated funds. The Contractor must not exceed the total amount of funds obligated on each Item. The Government is only obligated to pay the amount obligated on each Item.

Each order will include the following information:

• Order COR name and contact Information.

Each order may contain multiple items. Each item represents one contractor personnel. Unless stated otherwise in the item description, all positions are full-time.

Terms and conditions of the basic IDIQ are applicable to all orders issued against the IDIQ.

B.6 REPORTING REQUIREMENT FOR EXPENDITURES

It is the Contractor’s responsibility to track the hours and funding remaining for each item. When there is funding available for less than 120 hours for any particular item, the Contractor must notify the Contracting Officer and COR immediately. If the Contractor does not receive an executed modification adding the additional funding, the Contractor Program Manager must remove the employee from the order until a signed modification is received.

Occasional overtime may be required under this support order. To be eligible for overtime pay the contractor must notify the Contracting Officer and actually obtain his/her approval via email prior to performing the work. The eventual contract will also comply with state requirements related to how overtime is calculated where a contractor/subcontractor employee is located in that state. Overtime hours accrue when a single resource works more than 40 hours in a single week. PHMSA is not obligated to pay for overtime hours worked that were not approved ahead of time by the Contracting Officer or Contracting Officer Representative (COR).

B.9 MODIFICATIONS

All terms and conditions of the base IDIQ apply to all modifications issued under the base IDIQ.

PHMSA will order additional hours of work through the issuance of written modifications to the orders, using the SF 30 Form. All terms and conditions of the base IDIQ apply to all modifications to orders issued against the base IDIQ.
