About this file
This document is a justification for other than full and open competition for a construction project at the Alexandria VA Health Care System. The project will convert the facility's laundry to distribution and storage and requires new Siemens digital controls to integrate into the facility's existing Energy Management control system. As the VA recently completed a $6 million project to replace obsolete pneumatic HVAC controls campus-wide with Siemens controls, using other manufacturers' controls for this project would compromise the integrity and reliability of the control system network and require substantial additional investment to ensure compatibility. While some components will be specified as brand name only, the overall procurement will be competed as a service-disabled veteran-owned small business set-aside. The justification provides rationale for restricting competition and details market research and fair pricing determinations.

VHAPM Part 806.3 Other Than Full and Open Competition (OFOC) SOP Attachment 5: Request for Sole Source Justification Format
OFOC SOP Revision 11 Page 1 of 4 Original Date: 03/22/11 Revision 11 Date: 02/11/2021
DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition
Acquisition Plan Action ID: 36C25621AP1660
1. Contracting Activity:
Department of Veterans Affairs, VISN 16, Alexandria VA Health Care System. Network Contracting Office 16. 2237 #502-21-4-5785-0020.
2. Nature and/or Description of the Action Being Processed:
This justification is to support Project No. 502-17-300, Convert Laundry to Distribution and Storage at the Alexandria VA Health Care System that will be awarded as a firm-fixed price single award construction contract. This justification is for other than full and open competition for the procurement of the direct-digital control system of this requirement. The use of a particular brand name for the item listed below accommodates standardization of these items throughout the facility.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
The Alexandria VA Health Care System requires new Siemens controls for the Laundry project. The intent of the project is to provide new fully functional VAV units with new control systems. Controls will be integrated into the facilities existing Energy Management control system to allow for specific point monitoring and alarm functions.
4. Statutory Authority Permitting Other than Full and Open Competition:
1. Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency
Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;
X
2. Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;
3. Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;
4. International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4
5. Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR
6.302-5;
6. National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6;
7. Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;
OFOC SOP Revision 11 Page 2 of 4 Original Date: 03/22/11 Revision 11 Date: 02/11/2021
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The AVAHCS recently completed a nearly $6 million project to replace obsolete pneumatic HVAC controls with Siemens digital automated controls throughout the entire campus.
Siemens controls contain proprietary hardware and software that will not seamlessly interface with other control manufacturer’s hardware/software. Using other manufacturers’ controls would require substantial additional investment to make them compatible with existing systems, as well as additional service contracts to maintain and troubleshoot them.
It would not be feasible, either from a controls (technical) or a monetary (fiscal) standpoint, to compromise the integrity and reliability of the control system network that the taxpayers invested nearly $6M to build.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small-Business (SDVOSB) Set-Aside. This Justification for Other Than Full and Open Competition will be posted to Beta SAM Contract Opportunities with the solicitation.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable:
The Alexandria VA Health Care System provided a complete government estimate. The anticipated price to the Government for the items requested to be brand name is approximately
The items for which brand name approval is being requested are components to the overall construction project of standardizing HVAC Controls Campus wide. This procurement will be competed and based on competition; the Contracting Officer will make a determination at fair and reasonable pricing prior to award.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
Market research was not conducted as a competitive procurement process will be used.
Competing firms will deliver fair market prices for systems and items listed as all systems are common and use standard off the shelf components. The Contracting Officer and COR were in concurrence with information provided. Approval of the items as "brand name only" is critical for the overall efficiency of the completed project and the Alexandria VA Health Care System facility as a whole.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
New components must be able to tie into an existing and operational system including the use of software. At this time, there are no competing vendors whose products are fully compatible with the existing systems being used at the Alexandria VA Health Care System.
OFOC SOP Revision 11 Page 3 of 4 Original Date: 03/22/11 Revision 11 Date: 02/11/2021
Converting the entire facility to another manufacturer's system to accommodate portions of the facility complex would be extremely disruptive to medical center operations and prohibitively expensive.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
Not applicable. It is the responsibility of the offerors and the general contractor awarded the project to locate suppliers and obtain pricing for all materials and components, including the items listed in this justification.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any
Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
There will be competition for the overall procurement. It will be the responsibility of the offerors to obtain pricing from the suppliers of the items and to submit a competitive proposal for the project..
12. Requirements Certification:
a. I certify that the requirement outlined in this justification is a Bona Fide Need of the
Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
Ken Dillard General Engineer/Requestor/COR Alexandria VA Health Care System
