1.0 INTRODUCTION

Terracon Consultants, Inc. (Terracon) conducted a limited asbestos and lead-containing materials survey of the Clement J. Zablocki VA Medical Center’s (VAMC) Building 111 stairwells #1-6 located at 5000 West National Avenue, Milwaukee, Wisconsin. The survey was conducted on September 22-23, 2020, in accordance with Terracon Proposal No. P70207036, dated September 9, 2020.

The purpose of this survey report is to document the sample collection and quantification activities from the above-referenced locations at the site. The scope of Terracon’s services for the survey included the following:

n Sampling of suspect asbestos and lead-containing materials in stairwells #1-6 of Building 111 that will be affected by the planned replacement of fire sprinkler risers and n Completion of this survey report.

Interior sprinkler building components were surveyed, and homogeneous areas of suspect ACM were visually identified and documented. Although reasonable effort was made to survey accessible suspect materials, additional suspect but unsampled materials could be located in walls, in voids, or in other concealed areas. Suspect ACM samples were collected in accordance with the sampling protocols outlined in United States Environmental Protection Agency (USEPA) 40 Code of Federal Regulations Part 763-Asbestos, Subpart E-Asbestos-Containing Materials in Schools (40 CFR 763;

known as the Asbestos Hazard Emergency Response Act [AHERA]). Samples were delivered to an accredited laboratory for analysis by polarized light microscopy (PLM).

Terracon conducted a visual assessment of the stairwells to identify materials suspected of containing asbestos (suspect ACM) such as thermal system insulation, surfacing materials, and miscellaneous materials (e.g., floor tiles). All suspect materials were documented as homogenous areas; however, samples were only taken from friable/most suspect materials that were readily accessible and for which damage could be limited.

In conjunction with the asbestos survey, Terracon conducted a limited survey of representative interior components in stairwells #1-6 to identify painted surface components suspected of containing lead (suspect lead-based paint (LBP). Although reasonable effort was made to inspect

Responsive ■ Resourceful ■ Reliable 2 the substrates for unique painting combinations, additional suspect but untested paint could be located at the site due to an undetected change in the paints or variations in lead concentrations in homogeneous paint combinations.

1.1 Project Objective

We understand this assessment was requested in order to satisfy requirements of USEPA 40 CFR Part 61, Subpart M, the National Emission Standards for Hazardous Air Pollutants (NESHAP) for asbestos. The asbestos NESHAP requires that regulated and potentially regulated ACM be identified, classified, and quantified prior to planned renovation or demolition activities.

Lead is regulated by the USEPA and the Occupational Safety and Health Administration (OSHA).

The Resource Conservation and Recovery Act (RCRA) provides the USEPA with the authority to regulate disposal of renovation debris, including lead-containing materials. Specific regulatory requirements must be addressed prior to transporting, treating, storing, or disposing hazardous wastes. The lead paint survey was performed in accordance with the Wisconsin Department of Natural Resources (WDNR) guidance document WA-651, Planning your Demolition or Renovation Project: A Guide to Hazard Evaluation, Recycling and Waste Disposal.

1.2 Reliance

This report is prepared for the exclusive use and reliance of Apogee Consulting Group, P.A.

(Apogee). Use or reliance by any other party is prohibited without the written authorization of Apogee and Terracon.

Reliance on this report by Apogee and all authorized parties will be subject to the terms, conditions and limitations stated in the proposal, the report, and the Agreement for Services. The limitation of liability defined in Terracon’s Agreement for Services is the aggregate limit of Terracon’s liability to Apogee.

2.0 PROJECT/BUILDING DESCRIPTION

Terracon understands that Building 111 of the VAMC is scheduled for fire riser replacement in stairwells #1-6. These upgrades will include the demolition of select interior finishes in order to access and replace the sprinkler system systems.

Building 111 is a 13-story, approximately 850,000-square-foot building that was constructed circa 1965 and is utilized as a hospital and healthcare building containing multiple departments and clinics within the structure. The building was occupied and functioning at the time of inspection.

The stairwells’ interior walls and upper ceilings consist of concrete masonry unit (CMU) block, drywall, and plaster. The lower ceiling consists of acoustical drop-in ceiling tile and grid, and the flooring materials consist of floor tile, vinyl sheet flooring, and concrete.

3.0 FIELD ACTIVITIES

The survey was conducted by Mr. Alexander Davis, a State of Wisconsin licensed asbestos inspector (license number AII-182421). A copy of his license is attached as Appendix E. The survey was conducted in accordance with the sample collection protocols established in USEPA 40 CFR 763.86-Sampling. A summary of survey activities is provided below. VAMC staff provided Terracon access to the building, and an Apogee representative familiar with the project scope and details provided direction on the specific project scope for each floor/area to assist in guiding Terracon’s field services.

3.1.1 Visual Assessment

Survey activities were initiated with visual observation of Apogee-defined interior stairwells #1-6 in Building 111 to identify homogeneous areas and quantify visible and accessible materials suspected of containing asbestos (suspect ACM). A homogeneous area (HA) consists of materials that appear similar throughout in terms of color and texture with consideration given to the date of application. HAs of suspect ACM were visually identified and documented. Although reasonable effort was made to survey accessible suspect materials, additional suspect, but unsampled, materials could be located behind walls, voids or in other concealed areas. Materials identified as glass, wood or metal are not considered suspect ACM and therefore, were not sampled.

3.1.2 Physical Assessment

A physical assessment of each HA of suspect ACM was conducted to assess the friability and condition of the materials. A friable material is defined by the USEPA as a material that can be crumbled, pulverized, or reduced to powder by hand pressure when dry. Friability was assessed by physically touching suspect materials.

3.1.3 Sample Collection

Based on results of the visual observation and project/scope information from the Apogee representative, bulk samples of suspect friable ACMs were collected in accordance with USEPA sampling protocols. Bulk samples were collected using wet methods as applicable to reduce the potential for fiber release. Samples were placed in sealable containers and labeled with unique sample numbers using an indelible marker.

The selection of sample locations and frequency of sampling were directed by Apogee based on the proposed renovations to the building’s fire sprinkler systems and Terracon’s observations and the assumption that like materials in the same area and floors are homogeneous in content.

Terracon collected 49 bulk samples from 13 HAs of suspect ACM from stairwells #1-6 of Building

111. A summary of HAs identified and suspect ACM samples collected during the survey is included as Table 3 in Appendix A.

3.1.4 Sample Analysis

Bulk samples were submitted under chain of custody (COC) to EMSL Analytical, Inc. (EMSL), Cinnaminson, New Jersey for analysis by PLM with dispersion staining techniques per USEPA’s Method for the Determination of Asbestos in Bulk Building Materials (600/R-93/116). The percentage of asbestos, if present, was determined by microscopic visual estimation. EMSL is accredited under the National Voluntary Laboratory Accreditation Program (NVLAP; Accreditation No. 101048-0). Samples with asbestos concentrations less than 2% were point counted.

3.2.1 Lead-Containing Paint Survey

The LBP portion of the survey was completed concurrent with the asbestos survey. Mr. Davis collected paint chip samples for laboratory analysis to determine lead content. The purpose of the survey was to assess for the presence of LBP that might present a potential for airborne exposure to workers involved in demolition activities and the presence of other lead-containing materials that should be removed and properly disposed.

Terracon collected 7 bulk lead samples from the stairwells #1-6 of Building 111. A summary of suspect LBP samples collected during the survey is included as Table 4 in Appendix A.

4.0 REGULATORY OVERVIEW

4.1 Asbestos

The asbestos NESHAP (40 CFR Part 61, Subpart M) regulates asbestos fiber emissions and asbestos waste disposal practices. The asbestos NESHAP regulation also requires the identification and classification of existing ACM according to friability prior to demolition or renovation activity. Friable ACM is a material containing more than 1% asbestos that, when dry, can be crumbled, pulverized, or reduced to powder by hand pressure. All friable ACM is considered regulated ACM (RACM).

The asbestos NESHAP regulation classifies material subject to demolition or renovation as RACM, Category I nonfriable ACM, or Category II nonfriable ACM. RACM includes all friable ACM (pre-disturbance); Category I nonfriable ACM that becomes friable (during disturbance) or is subject to sanding, grinding, cutting, or abrading; or Category II nonfriable ACM with a high probability of becoming crumbled, pulverized, or reduced to powder by forces expected to act on the material during disturbance. Category I nonfriable ACMs are asbestos-containing packings, gaskets, resilient floor coverings, and asphalt roofing products that contain more than 1%

Responsive ■ Resourceful ■ Reliable 5 asbestos. Category II nonfriable ACMs are all other nonfriable materials (other than Category I nonfriable ACM) that contain more than 1% asbestos. Category II nonfriable ACM generally includes (but is not limited to) cementitious material such as cement pipes, cement siding, cement panels, glazing, mortar, and grouts.

The Wisconsin Department of Natural Resources (WDNR) regulations have incorporated the asbestos NESHAP by reference at NR 484.04(21s) of the Wisconsin Administrative Code. Under Chapter NR 447-Control of Asbestos Emissions, the owner or operator must provide WDNR with written notification and the appropriate fee at least 10 working days prior to the commencement of asbestos abatement activities that will disturb RACM in amounts greater than or equal to 160 square feet, 260 linear feet or 35 cubic feet.

The Wisconsin Department of Health Services (WDHS) enforces AHERA in the State of Wisconsin, including asbestos certification to ensure that asbestos abatement and management activities do not adversely affect health or safety. Chapter WDHS 159, Wisconsin Administrative Code, provides rules that apply when performing asbestos abatement or asbestos management activities in or on a school building or other publicly or privately-owned building when conducting asbestos abatement or asbestos management training for inspectors, management planners, project designers, supervisors, workers, roofing supervisors and roofing workers. During asbestos abatement projects, WDHS requires the posting of an occupant protection plan for the duration of the asbestos project and the completion of an Asbestos Project Log.

The Occupational Safety and Health Administration (OSHA) asbestos standard for the construction industry (29 CFR 1926.1101) regulates workplace exposure to asbestos during ACM removal. The OSHA standard requires that employee exposure to airborne asbestos fibers be maintained below the permissible exposure limits (PELs) of 0.1 asbestos fiber per cubic centimeter of air (0.1 f/cc) as an 8-hour time-weighted average (TWA) or 1.0 f/cc as a 30-minute excursion limit. The OSHA standard classifies the types of construction and maintenance activities that could disturb ACM and specifies work practices and precautions that employers must follow when engaging in each class of regulated work.

4.2 Lead-Containing Paint

LBP waste from renovation or demolition activities, such as debris, paint chips, dust, and sludges, that exhibit the toxicity characteristic must be managed and disposed as a hazardous waste under the Resource Conservation and Recovery Act (RCRA), except for whole-building demolition debris. If it is not a whole-building demolition debris, a composite, representative sample of the debris must be tested to determine if it is regulated as hazardous waste under 40 CFR 261 Identification and Listing of Hazardous Waste.

The USEPA action level for lead-based painted surfaces is equal to or greater than 1.0 mg/cm2 using the XRF method, or 0.5% dry weight by laboratory analysis. The USEPA definition of LBP is

Responsive ■ Resourceful ■ Reliable 6 directed at protecting the general population from exposure to lead in the residential setting. By contrast, the duty of OSHA is to protect workers during construction activities that may generate elevated airborne lead concentrations. OSHA states that construction work (which includes renovation, maintenance, and demolition) carried out on structures coated with paint that has lead concentrations lower than the USEPA regulatory limits can still result in airborne lead concentrations in excess of regulatory limits. The WDNR and WDHS also define LBP as a coating with a lead concentration of 0.5% or greater lead by weight using laboratory analysis.

The OSHA lead standard for construction (29 CFR 1926.62) applies to all construction work where an employee may be occupationally exposed to lead. All work related to construction, alteration or repair (including painting and decorating) is included. The lead standard applies to any detectable concentration of lead in paint (lead-containing paint (LCP)), as even small concentrations of lead can result in unacceptable employee exposures depending upon the method of removal and other workplace conditions. Under this standard, construction includes, but is not limited to, the following:

n Demolition or salvage of structures where lead or materials containing lead are present n Removal or encapsulation of materials containing lead n New construction, alteration, repair, or renovation of structures, substrates, or portions containing lead, or materials containing lead n Installation of products containing lead n Lead contamination/emergency clean-up n Transportation, disposal, storage, or containment of lead or materials containing lead on the site or location at which construction activities are performed n Maintenance operations associated with construction activities described above

Employers must assure that no employee will be exposed to lead at concentrations greater than 50 micrograms per cubic meter (mg/m3) averaged over an eight-hour period without adequate protection. The OSHA standard also establishes an action level of 30 mg/m3, which if exceeded, triggers certain requirements, including periodic exposure monitoring and medical monitoring.

USEPA regulates disposal of hazardous materials. The USEPA has stated that components removed with intact LBP that is not delaminating from the substrate may be disposed as general demolition debris. If the LBP is stripped from components, or if it is delaminating from the substrate, the waste may be subject to hazardous waste rules [i.e., Toxicity Characteristic Leaching Procedure

(TCLP)].

The WDHS administers lead training provider accreditation and certification programs. In addition to issuing certification cards and accrediting training provider courses for lead activities and investigations, the program establishes and monitors standards for conducting investigation and abatement activities. WDHS is also approved by the USEPA to administer and enforce the Lead- Safe Renovation program in Wisconsin. This program regulates renovation work performed for

Responsive ■ Resourceful ■ Reliable 7 compensation in a dwelling or child-occupied facility built before 1978 if the work disturbs 6 square feet (sq. ft.) or more of paint per room, 20 sq. ft. or more of exterior paint, or involves windows.

5.0 FINDINGS AND RECOMMENDATIONS

5.1 Asbestos Survey

Laboratory analysis of bulk samples confirmed the presence of asbestos in samples collected from the site building. See Appendix A for materials containing less than (<) 1% asbestos in Table 1, confirmed ACM sample summary in Table 2, and a list of the materials sampled in Table 3. A copy of the laboratory analytical report and chain-of-custody is included in Appendix B and a photolog of sampled materials is included as Appendix C.

ACMs must be removed by a licensed asbestos abatement contractor prior to renovation of the buildings and must be disposed of at an approved landfill.

Notes/Findings:

n 12-inch (”) x 12” vinyl floor tile medium gray with black and white streaks (<0.25% chrysotile) located in stairwell #3, 850 square feet (SF).

n 9” x 9” vinyl floor tile medium gray with black and white streaks and associated black mastic (2% chrysotile floor tile, 6% chrysotile mastic) located in stairwell #5, 900 SF.

n Brown mastic (<1 – 2% mastic) and associated black cove located in stairwell #6, 200 LF.

n Plaster off white with light texture (<1% chrysotile) located in basement chase under stairwell #6, 30 SF.

Based on the findings of the survey, Terracon recommends the following:

n All friable and nonfriable materials that will be impacted by the proposed renovations must be removed by a licensed asbestos abatement contractor prior to beginning the renovations and the waste must be transported to and disposed of at an approved landfill.

n Any suspect ACM not previously identified or sampled that is encountered during the renovations should be assumed ACM and should either be tested and confirmed via laboratory analysis or assumed to contain asbestos and disposed of in accordance with applicable rules and regulations.

5.2 Lead-Containing Paint Survey

Lead was identified above the laboratory reporting limit in the samples submitted for laboratory analysis. An LBP sample summary is included as Table 4 in Appendix A and the analytical laboratory report is included as Appendix B.

Terracon recommends that contractor(s) involved in the renovation activities involved outside the discussed scope of work should be informed of the potential presence of LBP and lead-containing paint (lead concentrations less than HUD/USEPA criterion) on unidentified building components.

OSHA’s lead standard for construction (29 CFR 1926.62) applies regardless of the concentration and contractor(s) will need to provide appropriate personal protective equipment and conduct personal exposure monitoring, at a minimum. Terracon recommends the contractor review the specified work tasks and methods involved in the renovation process and prepare a detailed LBP management plan. The LBP management plan should identify the work procedures and health and safety measures that will be used to control exposures to lead.

If waste materials containing LBP are generated, they may be regulated as hazardous waste.

LBP waste from renovation activities, such as debris, paint chips, dust, and sludges, that exhibit the toxicity characteristic must be managed and disposed of as a hazardous waste under RCRA.

For debris generated by renovation activities, a composite, representative sample of the debris should be tested to determine if it is regulated as hazardous waste under 40 CFR 261 Identification and Listing of Hazardous Waste. The hazardous waste criterion for lead wastes as established under RCRA, Subtitle C, is 5.0 milligrams per liter (mg/L) measured by the Toxicity Characteristic Leaching Procedure (TCLP).

6.0 LIMITATIONS/GENERAL COMMENTS

This survey was conducted in a manner consistent with the level of care and skill ordinarily exercised by members of the profession currently practicing under similar conditions in the same locale. The results, findings, conclusions, and recommendations expressed in this report are based on conditions observed during our survey. The information contained in this report is relevant to the dates on which this survey was performed and should not be relied upon to represent conditions at a later date. This report has been prepared on behalf of and exclusively for use by the client for specific application to their project as discussed. This report is not a bidding document. Contractors or consultants reviewing this report must draw their own conclusions regarding further investigation or remediation deemed necessary. Terracon does not warrant the work of regulatory agencies, laboratories, or other third parties supplying information that may have been used in the preparation of this report. No warranty, express or implied is made.

Materials containing less than 1% asbestos are not regulated by NESHAP; however, the OSHA asbestos regulations apply when materials containing 1% asbestos or less are disturbed during renovations or demolitions. A listing of materials that contain 1% asbestos or less is provided above to enable the renovation/demolition contractor to make appropriate decisions concerning compliance issues with applicable OSHA regulations.
