About this file
This is a Trench Safety Affidavit document required for the Fred Poppe Regional Park Bridge and New Roadway project in Florida, establishing compliance requirements with the Florida Trench Safety Act (Chapter 90-96, Laws of Florida) effective October 1, 1990. Bidders must acknowledge that all costs associated with trench safety compliance are included in their bid price and provide written assurance that they or any subcontractors performing trench excavation work will adhere to applicable trench safety standards. The document requires bidders to itemize and summarize trench safety measures by description, units of measure (linear feet or square yards), quantity, unit cost, and extended cost across multiple line items, with a total cost calculation mandatory for bid responsiveness.
All trench safety costs must be incorporated into the overall bid price, and the document explicitly states this is not a separate pay item. Bidders must comply with Occupational Safety and Health Administration (OSHA) excavation safety standards under 29 CFR 1926.650 Subpart P during construction. Failure to complete the affidavit and cost summary will render the bid non-responsive. The contractor bears full responsibility for OSHA compliance and will not receive additional payment if actual quantities differ from estimates or if alternative safety measures are employed. An authorized signature and date are required on the affidavit to confirm the bidder's recognition of trench safety compliance obligations.
