About this file
This is a Data Management Office Standard Data Requirements exhibit for a Learning Management System contract with the Texas Department of Criminal Justice (TDCJ). The exhibit establishes comprehensive data governance and security standards that the contractor must implement and maintain throughout the contract term. Key requirements include that all data produced, created, or maintained as part of the IT System shall be the property of TDCJ, and such data cannot be disclosed, sold, or used for purposes outside the contracted IT System without express written consent from the Department. The contractor is prohibited from responding to public information requests and must notify TDCJ of any court-ordered or administrative disclosure requests to allow the Department to file objections. Data classification, retention, and disposal must comply with Texas Government Code sections 2054.161, 441.185, and 441.187, with specific classification levels determined by TDCJ based on data sensitivity and security requirements.
The contractor must implement security controls proportionate to data classification levels and comply with TDCJ's Information Resources Security Program (IRSP) based on NIST 800-53 standards. Specific protection requirements apply to Personal Identifying Information (PII), Sensitive Personal Information (SPI), student education data under FERPA, Federal Tax Information, Payment Card Industry data, Protected Health Information under HIPAA, CJIS information, biometric identifiers, and any applicable GDPR provisions. All Department data must be encrypted both in transit and at rest per TDCJ IRSP standards. The contractor must establish data quality management processes, provide data availability within Department-specified timelines at no cost to TDCJ, and maintain disaster recovery protocols including data replication and scheduled backups. For cloud computing services, the contractor must disclose the cloud service provider and data center locations, which must remain within the continental United States unless expressly approved by the Department. Upon contract termination, the contractor must transfer all data, information, and records to TDCJ using secure methods and within Department-specified timeframes. The contractor is prohibited from using Artificial Intelligence in contract performance without prior written Department consent and must disclose any AI components used and their specific applications.
