About this file

This is a Request for Proposals (RFP) issued by the Michigan Department of Technology, Management and Budget (DTMB) for Indefinite Scope Indefinite Delivery (ISID) Design Build (DB) Entity services for tank and soil removal services at various locations throughout Michigan. The services include removal of contamination sources associated with former underground storage tank systems and other containment sources at multiple sites. Proposals are due on Thursday, April 3, 2025, at 2:00 p.m. Eastern Time. The contract term is two years, and DTMB expects to select multiple DB Entities. The work requires design and seal of a State of Michigan licensed engineer to meet applicable laws.

The contract will be used for minor, emergency and routine projects typically below $250,000 total cost. Payment and bonds are required for any project assignment with construction costs exceeding $50,000. The DB Entity's billing rates must include all overhead costs such as benefits, insurance, facilities, and equipment. Travel expenses are reimbursable only for projects over 100 miles from the contractor's office at State of Michigan rates. State prevailing wages apply to construction trades work, with rates determined at the time of individual projects. Firms awarded ISID contracts may participate in MIDeal, allowing them to contract with local governments and other eligible entities at the specified billable rates.

Contract for Minor Design Build Tank and Soil Removal Services

SECTION I GENERAL INFORMATION

I-1 Purpose

This Request for Proposals invites the prospective Design Build Entity (DBE) service contractor to prepare a qualifications statement and proposal for an Indefinite Scope Indefinite Delivery (ISID) contract for DB Entity engineering design services for the Department of Technology, Management and Budget (DTMB), State Facilities Administration (SFA), Design and Construction (DCD) and Michigan Department of Environment, Great Lakes, and Energy (EGLE) sites that require tank and soil removal services. ISID contracts provide the State of Michigan with a simple and streamlined qualifications-based selection process for obtaining DB Entity architectural and engineering services for minor, urgent and /or routine DB Entity services.

Project types expected to include the removal of sources of contamination associated with releases from former underground storage tank (UST) systems and other containment sources at multiple sites across the State. Construction trades work must use the State of Michigan prevailing wages obtained at the time of the individual project.

ISID contracts will be used for minor, emergency and / or routine projects, but client agency needs may require ISID contracting for other, or specialized projects. Most projects will be below $250,000 total cost. The ISID contracts will supplement, but not replace, standard bids as a method of obtaining design and construction services.

The 2025 Design Build for Tank and Soil Removal ISID contracts will be limited to a term of two (2) years. DTMB expects to select multiple DB Entities for these ISID contracts. Firms with ISID contracts are eligible to participate in MIDeal, a cooperative purchasing program, local units of government, K-12 schools, state colleges and universities, and not for profit hospitals, may, if the firm agrees to participate, contract with an ISID contract holder at the billable rates specified in the ISID contract.

Please Note:

1. FIRMS HOLDING ISID CONTRACTS ARE NOT GUARANTEED ANY ASSIGNMENTS

2. If your firm holds an ISID contract for other environmental, testing or another variety of ISID contract and you wish to provide Design Build services, please respond to this Request for Proposal.

If DTMB, Design and Construction Division (DCD) or EGLE determines that a particular project is suited to the ISID contracting method, The DCD Project Director / State Contract Manager (SCM) will select an ISID DB Entity to provide a specific proposal of services and fee for that project. If the proposal is acceptable, the project will be assigned to that DB Entity under their ISID contract. DCD reserves the option of requesting such informal proposal from more than one DB Entity for a particular project.

The DB Minor Project ISID contract will conform to the attached Sample ISID Design Build contract.

The minimum qualifications for consideration are demonstrated experience in the successful planning and execution of minor construction activities for similar projects in full accordance with all applicable Local, State, and Federal regulations, consistent with schedule and budget, accurately and with efficient interaction with the client agency and DCD.

The conceptual design for a project may be provided by the DCD or Client Agency. However, the DB

Entity will be responsible for providing whatever detailed design and documentation will be required for permitting and construction.

The DB Entity will be responsible for coordinating their work with any other state crews or contractors/subcontractors working in the area.

For this RFP, the DB Entity must provide qualifications and personnel billing rates for:

the architect and/or engineer responsible for final design and documentation the general contractor or construction manager

I-1 Project/Program Statement

See attached project/program statement for more detailed information. The DB Entity, by submitting a Technical (Part I) and Cost (Part II) Proposal to DTMB for evaluation, states that they can and will provide a complete service when a project is assigned to them.

No increase in compensation to the DB Entity will be allowed unless there is a material change made to the scope of work of the project / program statement and the change to the project / program statement is approved in writing by DTMB, State Facilities Administration (SFA), Design and Construction Division (DCD).

Should sub-consultant be required for a particular project, their fees will be included in individually assigned project contracts as not-to-exceed reimbursable amounts fees will be included in individually assigned project contracts as not-to-exceed reimbursable amounts.

To determine your current billing rates, use the attached guideline page for information regarding the “Overhead Items Used for DB Entity Firm’s Billing Rates Calculation,” and the web-link to “Sample Standard ISID Contract for DB Entity Services,” Article 2 – Compensation.

Consultants providing design services must submit separate billing rates for services that they will provide. A reasonable yearly increase of the DB Entity’s billing rates, not to exceed 5%, will be allowed.

However, the DB Entity is required to complete and submit one or more of the 2025 TANK AND SOIL REMOVAL COST SHEET(s), which includes the Example Site and Unit Pricing sheet for EACH of the EGLE District Offices in which they are interested in providing services. The quantities indicated in these sheets are the potential maximum costs per district the DB Entity’s bids on and they will be used in this RFP for pricing only. Actual sites will have different quantities.

If the professional is selected for contract award to provide services in an EGLE district, the sheet completed and submitted by the DB Entity for that district office will be used to establish the unit prices and schedule of values for future assignment(s) located within the boundary of that district office.

III-3 STANDARD DB ISID CONTRACT PROVISIONS

The DB Entity agrees to the terms and conditions stipulated in the Standard DB ISID Contract Provisions and will be required to execute the attached Standard DB ISID Contract Provisions language for design-build services. If an item is not applicable to the assigned site for tank/soil removal, it will not be enforced. The contract will be as outlined in the RFP. For example, it is not anticipated that a registered surveyor will be utilized at every site, but accurate as-built drawings will be required as part of the Construction Removal Report. Builder’s Risk Insurance will not be required but each assignment will have its own prevailing wage rates.

Each assignment will have its unique requirements. The liquidated damages may apply to one assignment but not to other assignments and will be clearly identified in the assignment’s scope of work.

However, it is not anticipated that liquidated damages will be applied with the majority of assignments under this contract.

Most of the assignments will not be federally funded work, and Davis Bacon Act will not apply. However, State of Michigan prevailing wage rates will apply, and each assignment will have its own prevailing wage rates. The firms will need to factor in the potentially applied prevailing wage rates into the unit rate prices for the corresponding counties/districts.

Use the attached DB forms to establish your total compensation.

The following instructions are to be used by the DB Entity Services Contractor firms to determine the hourly billing rate to use on State of Michigan projects.

The DB Entity’s Consultant must submit a separate hourly billing rate for the DB Entity consultant services they will provide for State of Michigan Projects. No mark-up of the DB Entity’s Consultant services hourly billing rates will be allowed.

The Department will reimburse the DB Entity for the actual cost of printing and reproduction of the contract bidding documents, soil borings, surveys and any required laboratory testing services and use of field equipment. No mark-up of these Project costs will be allowed
