About this file
This is a Florida Trench Safety Act Certification and Disclosure Statement issued by Hillsborough County, Florida, establishing mandatory compliance requirements for bidders on excavation and trench work projects. The document requires all bidders to acknowledge and certify their understanding of the Florida Trench Safety Act and commit to compliance with Federal excavation safety standards as outlined in 29 CFR Part 1926.650, Subpart P, which serves as the interim State standard. Bidders must demonstrate that they have considered geotechnical information from the County and other relevant sources in designing their trench safety systems and acknowledge sole responsibility for both data selection and system design. The certification includes a detailed itemization table where bidders must disclose the specific trench safety measures they will employ, including unit quantities, measurements in linear feet, unit costs, and extended costs for each safety approach.
The disclosure statement clarifies that the amount bidders submit for trench safety compliance represents only the initial budgeted safety measures and does not constitute the full extent of their contractual obligation to maintain safety standards. Contractors must expend additional funds as necessary to achieve full compliance with applicable trench safety requirements at no additional cost to the County, except as otherwise provided in contract documents. The County explicitly reserves the right to determine that disclosed costs may be inadequate and affirms that bid acceptance does not relieve the contractor of its sole responsibility for trench safety compliance. This certification must be signed by an authorized representative of the bidding firm and submitted with the bid response.

1. The bidder acknowledges the Florida Trench Safety Act and the requirements established herein.
2. The bidder further acknowledges that the aforementioned Act established the Federal excavation safety standards set forth at 29
CFR Part 1926.650, Subpart P as the interim State standard until such time as the State of Florida, through its Department of Labor and Employment Security, or any successor agency, adopts, updates or reviews said interim standard. The Contractor acknowledges that it is solely responsible for the selection of the data on which it relies in designing said safety system, as well as for the system itself.
