About this file

This is a Felony Conviction Notification form required by the State of Texas under Legislative Senate Bill No. 1, Section 44.034, applicable to entities entering into contracts with school districts. The form serves as a mandatory disclosure document through which bidders and contractors must certify their criminal history status prior to contract award. The form requires an authorized agent of the firm to review and verify the accuracy of felony conviction information and to check one of three boxes: confirming the firm is a publicly-held corporation exempt from the reporting requirement, certifying that the firm and its owners or operators have no felony convictions, or disclosing any felony convictions of firm owners or operators along with details of such convictions.

Texas school districts are authorized under this statute to terminate contracts with entities that fail to provide the required notice or that misrepresent information regarding felony convictions, though the district must compensate the contractor for services performed prior to contract termination. The form includes signature blocks for the authorized representative and requires completion of company name, printed name of authorized agent, and title. The notification requirement applies to all non-publicly-held corporations, businesses, and individuals entering into school district contracts and represents a compliance threshold that must be satisfied during the bidding and contract administration process.

FELONY CONVICTION NOTIFICATION

State of Texas Legislative Senate Bill No. 1, Section 44.034, Notification of Criminal History, Subsection (a), states “a person or business entity that enters into a contract with a school district must give advance notice to the district if the person or an owner or operator of the business entity has been convicted of a felony. The notice must include a general description of the conduct resulting in the conviction of a felony.”

Subsection (b) states “a school district may terminate a contract with a person or business entity if the district determines that the person or business entity failed to give notice as required by Subsection (a) or misrepresented the conduct resulting in the conviction.
