About this file
This document outlines quality assurance and performance requirements for a medical kit sustainment contract with the U.S. Department of State. The contractor must submit quarterly Quality Assurance and Compliance Reports showing how it has met specific performance thresholds, such as on-time delivery and kit functionality. These reports are due on January 15, April 30, July 15, and October 8 each year. If thresholds are not met, the contractor must provide mitigation plans. Waivers can be requested within seven days of non-compliance notices only under certain circumstances. Acceptable performance will be determined based on these quality and timeliness standards. The related federal contract opportunity is for the procurement, assembly, distribution, warehousing, data management, tracking, and life cycle sustainment services of standardized emergency response kits and supplies to all Department of State posts worldwide under solicitation number 19AQMM18R0176.

Quality Assurance and Acceptable Levels of Performance
a) All services and supplies procured under this contract will be subject, at all times, to inspection by the Government. Although the Government retains the right to specifically enforce all provisions in the contract, the Performance Requirements Chart below identifies those contract requirements considered most critical to acceptable contract performance and provides the Government’s intended quality assurance procedures.
b) The Contracting Officer and his/her representatives are responsible for inspection and acceptance of the Contractor’s effort under this contract. The Contractor shall submit quarterly Quality Assurance and Compliance Reports (QACR) showing how it met or failed to meet the performance requirements listed below. If the Contractor failed to meet the Performance Threshold/Acceptable Quality Level (AQL) for a given performance requirement, it shall submit a detailed narrative as to what actions have been taken to mitigate any future non-compliance.
1st Quarter Report due January 15 2nd Quarter Report due April 30 3rd Quarter Report due July 15 4th Quarter Report due October 8
c) If the Contractor believes that mitigating circumstances precluded the Contractor from meeting the terms and conditions of the contract as it relates to performance or administration of the contract, a request for waiver can be requested. The Contractor shall provide a detailed explanation as to why the circumstances surrounding the contract noncompliance occurred and why this action could not have been prevented. This request must be submitted to the CO and COR within seven (7) calendar days from receipt of notice of noncompliant performance, unless otherwise approved by the CO or COR.
