Amendment 1 Questions and Answers
1: Will NPS accept past performance surveys that are not identical to the Past Performance Survey accompanying the solicitation for this opportunity?
Response: Sections L and M of the solicitation state (in part):
Section L:
Non-Price Factor 2: Prime Contractor’s Past Performance: (Maximum of 5 Contracts / Past Performance Survey Questionnaires.)
Past Performance is a measure of how well the Contractor performed the work of previous contracts, and the degree to which the Contractor satisfied its customers. Evaluation of past performance will be based on consideration of all relevant facts and circumstances. It will include an assessment and determination of the offeror’s overall commitment to customer satisfaction and will include conclusions of informed judgment. The elements of past performance that will be evaluated include: Quality of Product / Service; Documentation Quality; Worksite Safety; Cost Control; Management Responsiveness;
and Contract Management. Offerors are encouraged to provide information on any significant problems or issues encountered on the submitted contracts and the offerors remedy or corrective actions. If no significant problems / issues were encountered, the offeror should state so.
Offerors shall complete the information on Attachment B: Past Performance Survey with the information associated with the projects submitted in response to evaluation factor 1.
Section M:
Past Performance will be evaluated based upon how well an offeror performed the work of previous contracts, and the degree to which the offeror satisfied its customers. Evaluation of past performance will be based on consideration of all relevant facts and circumstances. Evaluation will include an assessment and determination of the offeror’s overall commitment to customer satisfaction and will include conclusions of informed judgment. The elements of past performance that will be evaluated include:
a. Quality of Product / Service
b. Documentation Quality
c. Worksite Safety
d. Cost Control
e. Management Responsiveness
f. Contract Management
If the contractor chooses to submit a past performance survey in a different format, they are advised that it may adversely affect their past performance evaluation if the survey submitted does not address the items listed in Sections L and M sufficiently, and/ or does not include the projects submitted in response to evaluation factor 1.
2: Is a statement of financial capability to be included directly on the cover letter, or will a separate letter of financial capability suffice?
Answer: item k, Financial Capability, listed under Electronic File #1 states:
Submit proof of financial ability with the most recent financial statement covering assets and liabilities.
Include the name, address and telephone number of firms’ banking institution(s).
Although “k” is listed under the Cover Letter requirements, it is understood to be the actual financial statements. The financial statements are required to be included in Electronic File #1.
3: Please confirm the “complete seed task order proposal with all supporting documents” is not included in the 30 page limitation for the Non-Price Factor 3.
Answer: Yes, the seed task order complete proposal is in addition to the 30 page limitation under Non-
Price Factor 3: Technical Approach and Management Plans (Electronic File #2).
4: Will the Government allow a cover page for each file that is not included in the page count to enable offerors to include the disclaimer provided in FAR 52.215-01? Answer: Yes
5: Please confirm that offerors may provide a table of contents for each volume that is not included in the page count? Answer: Yes
6: Section 1.3. states: All negotiated and accepted proposal elements, line items and pricing for shelved task orders shall be guaranteed by the SABER Contractor for 365 calendar days.
Project costs have become extremely volatile and it’s not uncommon to have cost increases of 20%-
30% over the course of a year. Guaranteeing pricing for up to a year will significantly increase the coefficient. Will the NPS consider reducing the time associated with Shelved Task Orders?
As an alternative, will the NPS consider two coefficients? One for Standard Task Orders and one for
Shelved Task Orders?
Answer: To address this concern, the solicitation is amended to add: shelved task order pricing will be adjusted to the most current quarter of e4clicks pricing (up or down) at the time the shelved task order is awarded. There will be no change to the accepted line items or line item quantities.
7: Section C.1.3.B., Table – A, Shelved Task Order Fee The solicitation states that this fee is intended for the contractor, among other things, to hold and guarantee pricing for the task order for up to 365 days.
Project costs have become extremely volatile and it’s not uncommon to have cost increases of 20%-
30% over the course of a year. The Shelving Fee (ranging from 0.25%-1.25%) isn’t nearly sufficient to hold a price for up to 365 days. Will the NPS consider increasing the Shelved Task Order Fees to a more reasonable percentage based on current market conditions? As an alternative, will the NPS consider two coefficients? One for Standard Task Orders and one for Shelved Task Orders?
Answer: To address this concern, the solicitation is amended to add: shelved task order pricing will be adjusted to the most current quarter of e4clicks pricing (up or down) at the time the shelved task order is awarded. There will be no change to the accepted line items or line item quantities. There is no separate co-efficient for shelved task orders.
8. Will NPS allow us to submit pricing for the seed task order via normal generally-accepted methods, or is the CPG (e4Clicks w/RS Means Master Composite) referenced in the solicitation the only acceptable option for pricing the seed task order?
Answer: It will be important that the successful contractor(s) are able to proficiently work within e4Clicks/RS Means Master Composite software from contract inception. As addressed in the solicitation evaluation factors, the development of the seed project using this software will help the Government team to "verify the offeror’s correct application of the proposed coefficient, correct RS Means Cost City Index and RS Means Quarter, accuracy of line items and any other price components for price reasonableness." If the offeror is unable to complete the cost estimate using e4Clicks/RS Means software, they should use similar cost estimating software, identify the software used, and address in their price/coefficient narrative how they will be able to successfully be able to work within the required software upon contract award.
9. Contract vehicle questions:
a) Reference Solicitation SOW provisions and clauses para 1.3 Task Order types: What is the anticipated percentage of standard task orders vs. shelved task orders on an annual basis for this SABER?
b) Reference Solicitation SOW provisions and clauses para 1.3 Task Order types: What size range ($ amount) are shelved task orders typically?
Answer: The NPS has not collected this data and therefore does not have this information to provide. It is anticipated that the need for shelved task orders would be infrequent, and the dollar value is likely under the Simplified Acquisition Threshold (Currently $250k). However this is not a guarantee, and the contractor will need to meet the contract requirements if shelved task orders are needed.
Seed project questions:
1. Reference SOW para 4.4n: What is the client’s desired location for new emergency disconnect switch on the east side of the tank? - Same location as the existing one on the "Cold Storage
Building"
2. Reference SOW para 4: Is the curb that extends off the fuel pad and spans between bldg. 5 and fuel pad to be removed as part of the SOW? If so what needs to replace it? - Yes it should be removed and the asphalt patched.
3. Reference SOW para 4.4: Is it acceptable for the electrical conduit and piping from new fuel tank to dispenser be above ground for the new system? - Yes - but just from the new tank to the new pump, conduit to the card reader and the empty conduit for the future EV station shall be below grade.
4. Reference SOW 4.0: Given the history of buried tanks and fuel piping on site, soil sampling should be required underneath old conduit and dispensers. Has there been any known fuel spillage in the history of the site? - No known spillage in the area so no soil testing is anticipated unless there is an obvious odor in the soil when it is exposed to air.
5. Reference SOW para 4.3e: As part of the SOW will pouring a new curb on SW side of pad? - As part of the scope of work for reducing the size of the secondary containment area to just what is required for the new diesel tank a new curb will be needed.
6. Reference SOW 4.0: We anticipate 3rd party testing is required for compaction and concrete strength testing to ensure basecourse is adequate for new parking spaces and concrete has adequate strength for the new tank. Is there geotechnical information and record drawings of the concrete pad available for reference? - We are not anticipating a requirement for third party testing for the 95% compaction under new asphalt. We are unable to find any geotechnical information for the existing concrete pad so please assume that it is reinforced and sufficiently thick to support the existing and new tank.
7. Reference SOW para 9.b: Based on the client’s desired location of electrical box, there is concern it will interfere with curb/bollards/location of EV charging station. A) Is there more information on the future charging station to guide the electrical box location? B) Is there a projected general footprint size of the EV charging setup? - The future EV charging station will be installed in the same location as the old unleaded pump, which shall be removed, and the footprint is anticipated to be similar or smaller in size, bring the empty conduit in below grade and stub up in small, temporary, electrical box.
8. Reference SOW para 4: How many parking spots are desired in the location where the portion of the existing pad is to be removed? - 2
9. Reference SOW para 4: What is the allowed route for construction vehicles and deliveries and construction staging area? - Construction vehicles can use the area as necessary - staging will be allowed in the area between the fuel island and the Oil House, or in the park's boneyard (1/4 mile away) if the needs exceed the available space.
10. Considering the planned construction work hours of 0700-1630, are there any additional special events, meetings, holidays, or key maintenance activities that need to be taken into account for project scheduling? - No, other than all federal holidays.
11. Are there any restricted access areas surrounding the proposed project site? - Not during regular business hours
12. Reference SOW para 4.1: What is the governing regulation for clearance between the tank and any surrounding infrastructure (bollards, etc)? - The governing regulation for tank clearance is up to the Federal Government. State regulations are advisory. For the Bollards, the NPS has determined that a 2 foot clearance between the bollard and tank is sufficient for the kinds of vehicles and vehicle speeds that are possible in this location.
13. Reference SOW Para 4.4r. Is pavement marking to indicate new parking spots for future EV charging station to be included in the SOW? - No
14. Reference SOW para 4.2: From the site visit, no historic features were identified, please clarify what is meant by historic masonry and materials - Any curbing or masonry associated with the Oil
Storage Building is historic, that associated with the Fuel Island is not.
15. Reference SOW Para 4: While it does not appear to be the case, are there any archeological concerns associated with the site and SOW? - No concerns are anticipated; however the park archaeologist may elect to observe any excavation but that should not impact the operation
(unless something unexpected is discovered).
16. Reference SOW Para 4: There is no mention of temporary facilities for fueling Park Service vehicles during the 60-day construction period. Should any temporary fueling facilities by included in the
SOW? - No, the park will make do by fueling in town.
17. Due to material, equipment, tank fabrication lead times, can/will the completed dates be extended beyond the July 1, 2022 thru August 30, 2022 dates? – Since we have little control over current lead times, we will certainly be reasonable once the contract has been awarded and lead times can be confirmed.
18. With the new conduit runs from the power panel to the existing tank pad area being installed underground, AT the existing tank pad area, can the conduits then be installed at grade? - Yes - but just from the new tank to the new pump, conduit to the card reader and the empty conduit for the future EV station shall be below grade.
19. The conduit that is needed for the future EV Charging stations, can it be stubbed up at the new end section of the tank pad on the South side and capped? - The future EV charging station will be installed in the same location as the old unleaded pump, which shall be removed, bring the empty conduit in below grade and stub up in small, temporary, electrical box where the old pump stood.
20. The existing emergency shut off switch is within code distances, does it needed to be relocated, as stated in 4.0, 3., e.? – No, it can stay in it’s current location.
21. Will you approve a Fireguard tank which is a UL2085 double wall, horizontal with primary and secondary walls and interstitial space? The Fireguard tank is an equivalent to a Convault tank. We are not opposed to an alternate tank, but this is not something that can be pre-approved. An “or equal” determination will be made during the normal submittal review process.
22. Does any new concrete/curb replacement need to be colored to match existing concrete color, as much as possible? - Yes
23. How many cards are needed for the new card system? – About 20
24. Is USB flash drive inserted into the card reader pedestal the presumed way the NPS will retrieve fuel transactions direct at the card reader and a Fuel Management card reader software package is not needed for remote communication and polling of fuel transactions to a NPS provided PC? - Yes
25. Is the new electrical fuel panel, to be for all fuel equipment only and not include any other existing electrical systems in current panel? Does the spare conduits for the future EV charging stations stub into this panel? - There is no need for a “new electrical panel” the spare conduits shall simply stub up on the fuel island and in the water treatment room.
26. Can the new diesel product piping from the submersible turbine at the tank, to the new dispenser be run aboveground, instead of underground as the existing is? - Yes, which eliminates the need for an electronic liquid level monitoring system.
27. The SOW states unleaded gasoline in several places, will that be corrected to state the project is for diesel fuel only? - Yes
28. Will the NPS deliver fuel to the new tank upon contractor’s request to test the system? – Yes
