PROVISIONS

Provisions Incorporate by Full Text

52.212‐1 Addendum

52.212-1 Instructions to Offerors – Commercial Items, is replaced in its entirety by this addendum.

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449).

(b) Submission of Quotes. Submit quotes to Jim Roloff at james.g.roloff@usda.gov at or before the date/time specified in this solicitation (block 8). See “Notes to Quoters.”

(c) Submission deadline. Quotes must be received by the date and time specified in this solicitation. A late quote will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late quote would not unduly delay the acquisition. In the case of an emergency or unanticipated event that mailto:james.g.roloff@usda.gov delays Government operations so that quotes cannot be received, the deadline will be extended by one working day.

(d) Terms and content. Quotes must be based on the terms of this solicitation. The Government may reject any quote that is not based on these terms in every respect. Quotes must contain all information required by the solicitation.

(e) Contract award. The Government intends to evaluate quotes and award a contract without discussions. Therefore, a quote should contain the quoter’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in quotes received. Quoters are responsible for ensuring completeness of their quote. The Government may evaluate solely on the information provided with the quotation.

(f) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of a quote, the quoter acknowledges that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the quoter does not become registered in the SAM database by the response date specified in the solicitation, the Contracting Officer will proceed to award to the next otherwise successful registered quoter.

Quoters may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://sam.gov/content/home.

(g) Requests for information. The contracting officer will not notify unsuccessful quoters that responded to this solicitation. Quoters may request information on award resulting from this solicitation from the contracting officer.

52.212-2 Evaluation—Commercial Products and Commercial Services (Nov 2021)

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(a) Technical capability of the offeror to meet the Government requirement. i.e., relevant experience;

(b) Price;

(c) Past performance: Past performance is a measure of the degree to which an offeror has satisfied customers in the past, and complied with federal, state, and local laws and regulations. The assessment of past performance will be subjective and based mainly on offeror reputations with customers and adherence to schedules. The Government may evaluate the performance data provided by offerors or obtained from other sources. Past performance assessments may be based on information such as the https://sam.gov/content/home contracting officer’s and evaluator’s knowledge of previous experience with the service being acquired, customer surveys, or other reasonable basis. The assessment will consider the contractor’s record of conforming to specifications, and to standards of good performance/customer service. In addition, adherence to contract schedules, including the administrative aspects of performance, will be taken into consideration. The currency and relevance of the information, source of the information, context of the data, and general trends in contractor’s performance shall be considered. References, which may be the same as those submitted to demonstrate relevant experience (if so, please specify), shall include:

o Contract number and price o Project title or name o Location o Award and completion dates o Name, phone, and email address of the contact person familiar with the project

Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option.

(End of Provision)

52.212-3 Offeror Representations and Certifications—Commercial Products and Commercial Services (Dec 2022)
