Replace Section M with the following:

SECTION M--EVALUATION FACTORS FOR AWARD

Award Determination

(a) The Government will evaluate proposals received in response to this solicitation and intends to award one contract to the responsible offeror whose proposal provides the best value to the Government. The Government may make award to other than the lowest-price offeror if that higher-priced offeror’s proposal provides the best value. The factors to be used in the best value decision are—

• Past Performance,

• Experience,

• Technical Approach,

• Price

(b) Non-price factors are listed in order of importance. When combined, the non-price factors are more important than price.

Past Performance Past performance is a measure of the degree to which the offeror (including major subcontracts) has satisfied previous customers and complied with Federal, State and Local laws and regulations. The Government will contact references, use informaiton in databases or use personal experience to assess the past performance history of the project team, including history of quality workmanship, timely completion, history reasonable and cooperative behavior, concern for customer satisfaction and compliance with contract requirements.

Where there is little or no information available regarding the offeror’s past performance history because the offeror is new to the marketplace, the past performance evaluation may take into account information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the work. When no information is available, the offeror will not be evaluated favorably or unfavorably on past performance.

The past performance evaluation will characterize the level of the Government’s confidence that the offeror will successfully complete the work, in compliance with all contract requirements, based on its record of successful performance on recent and relevant similar projects.

In the past performance evaluation, the Government may use information from sources other than the offeror’s proposal. Other sources of information, may include, but are not limited to: Federal, State and Local government agencies, better business bureaus, published media and electronic databases such as the Past Performance Information Retrieval System (PPIRS).

Experience The Government will evaluate the offeror’s qualifications based on the bredth, depth and relevance of their past experience.

12010918R0009 – Windfall Lake Trail Bridges

Technical Approach The Government will evaluate:

(1) The offeror’s understanding of the work

(2) The soundness of the offeror’s approach to meeting contract requirements, including constructing this project; housing the work crew; mobilizing personnel, equipment and materials; and the proposed work schedule

(3) The government’s perceived risk(s) with the offeror’s approach including project and worksite safety

Price The Government will evaluate the total price, including the base and option item, for reasonableness.

Notice of Award A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
