About this file
This is an Arkansas Performance and Payment Bond form mandated under Arkansas Statutes 14-604, required for the City of Little Rock Department of Housing and Neighborhood Programs' parking lot construction project at 1419 Park Street (LR Nine Way), Little Rock, AR 72202. The bond serves as a performance and payment guarantee for residential construction services and must be executed by the contractor (principal) and a surety company, with the bond amount to be determined based on the contract value. The bond document is executed in six counterparts and must be dated on or after the contract date, with all signatures and seals required from the principal, surety, and witnesses.
The bond obligates the principal and surety to ensure faithful performance of all contract terms, payment to all subcontractors and material suppliers, and compliance with prevailing wage requirements as determined by either the Arkansas Department of Labor or U.S. Secretary of Labor, whichever is greater. The surety agrees that changes, extensions, alterations, or additions to the contract terms or specifications shall not affect its bond obligation, and the surety waives notice of such modifications. The bond further guarantees payment of all costs associated with construction including materials, equipment rentals, labor, workers' compensation insurance, and applicable state and local taxes. The surety must be represented by an Arkansas Local Resident Agency for proper execution of the bond.
