About this file

This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman for use in conjunction with the State of Utah Division of Purchasing's RFP NC27-116 for a Non-Functional Turf Case Study. The form is designed to allow vendors submitting proposals to protect trade secrets and commercial financial information under the provisions of Utah Code 63G-2-305 and 63G-2-309. The RFP seeks a single contract award for an 18-month engagement (with work scope completion required within 12 months) to provide a baseline framework study and deep-dive technical and economic case study on non-functional turf management within the Great Salt Lake watershed, targeting selected public or private institutions such as university campuses, municipal facilities, or school districts. Vendors responding to this procurement must submit both redacted and non-redacted versions of their proposals, with the Division of Purchasing declining to perform redactions on behalf of claimants who fail to provide a redacted copy.

The confidentiality claim form requires vendors to provide complete company information, including representative contact details and specific identification of the pages, paragraphs, and reasons for confidentiality protection being claimed. Vendors must include a concise statement of reasons supporting their confidentiality claims and submit the form contemporaneously with their proposal materials. The form emphasizes that submission of a confidentiality claim does not guarantee protected classification status if the governmental entity receives a GRAMA (Government Records Access and Management Act) records request. Vendor pricing must be guaranteed for the 12-month work period, with the additional six months of the contract term allocated for administrative closeout activities.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
