About this file
This is a GRAMA Business Confidentiality Claim form submitted to the Utah State Archives and the Office of the Government Records Ombudsman in connection with the West Valley Campus 2/3 Expansion RFP issued by the State of Utah Division of Purchasing on behalf of Utah Charter Academies (UCA). The form provides the procedural framework for vendors to claim protection of trade secrets and commercial financial information submitted in response to the general contracting RFP for a building expansion project. The RFP solicits general contracting services and all materials necessary to complete expansions at the West Valley 2/3 campus, including a six-classroom elementary addition with breakout classrooms and restrooms (Phase 1, required to open August 2027), a secondary classroom addition for performing arts, an auditorium addition with support spaces, and an optional lunch kitchen building shell. A mandatory pre-proposal meeting was scheduled for Thursday, August 27th at 10:00 AM on-site, with the submission deadline extended to Thursday, September 10th at 5:00 PM. The contract will run through project completion, with the selected vendor required to guarantee pricing for six months.
The confidentiality claim form requires vendors to submit both redacted and non-redacted versions of their proposals, with the Division of Purchasing declining to redact proposals on behalf of claimants who fail to provide a redacted copy. Per Utah Code 63G-2-305, trade secrets and commercial financial information that could reasonably result in unfair competitive injury are eligible for protected classification if accompanied by a timely confidentiality claim including a concise statement of reasons. Claimants must provide company information, specify which pages and paragraphs require protection, and document the reasons for each confidentiality request. The form notes that submission of a confidentiality claim does not guarantee protected classification if the governmental entity receives a public records request.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
