About this opportunity
The State of Utah Division of Purchasing, conducting procurement on behalf of the Utah Department of Corrections (UDC), is requesting proposals for multiple contracts to supply second market food products (surplus, short-dated, overstock, misbranded, seasonal, and closeout items in fresh, frozen, refrigerated, and shelf-stable formats) to two prison facilities and six community correctional centers throughout Utah, with proposals due October 20, 2026.
The procurement anticipates multiple contract awards. Following award, subsequent purchase orders will be issued through competitive quote requests among all awarded vendors, with orders going to the lowest-priced technically acceptable quote. Vendors must supply products accommodating religious dietary needs including Kosher and Halal items and provide comprehensive product catalogs with full cost sheets. Pricing must be guaranteed for three months with quarterly adjustment options requiring ten days' notice and supporting market analysis documentation. Delivery must be F.O.B. destination with all transportation, handling, and freight charges included in the bid price; no fuel surcharges are permitted. Lead times should not exceed 7–14 days after order receipt, with normal deliveries Monday through Friday between 8:00 a.m. and 3:00 p.m.
All products must comply with FDA regulations, the Food Safety Modernization Act, and Utah Department of Agriculture and Food requirements. Vendors must provide inventory tracking systems with real-time visibility and expiration-date management. All contractor personnel entering UDC properties must undergo background checks and obtain Contractor Identification; security clearance is required prior to access at correctional facilities.
Evaluation occurs in three stages. Stage 1 eliminates non-responsive proposals not meeting Minimum Mandatory Requirements. Stage 2 applies technical scoring across four criteria: company experience (100 points), product sourcing and quality (400 points), food safety and compliance (300 points), and logistics and distribution (200 points), for 1,000 total points. Offerors must achieve 700 points (70%) to advance to Stage 3 cost evaluation. Stage 3 awards 250 points maximum to the lowest-cost proposal; all other offerors receive proportional points based on pricing comparison. Offerors meeting or exceeding 875 combined points (70% of 1,250 possible) qualify for contract award. Vendors must submit technical and cost proposals as completely separate documents; pricing information included in technical responses results in non-responsive status.

Issuing Procurement Unit: State of Utah Division of Purchasing Conducting Procurement Unit: Utah Department of Corrections (UDC) The purpose of this RFP is to enter into multiple contracts to provide: Second Market Food Products It is anticipated that this RFP will result in multiple contract awards. Subsequent order placements will be conducted via competitive quote requests among all awarded contracts, with purchase orders issued to the lowest-priced technically acceptable quote. The methodology or formula that will be used to determine the number of contract awards is: Stage 1: Initial Review In the initial phase of the evaluation process, the conducting procurement unit will review all proposals timely received and meet Minimum Mandatory Requirements (MMRs). Non-responsive proposals not conforming to RFP requirements or unable to meet the mandatory minimum requirements will be eliminated from further consideration. Stage 2: Technical Proposal Evaluation Responsive proposals will then be evaluated by an evaluation committee appointed by the conducting procurement unit against the proposal evaluation criteria noted in the Technical Criteria prerequisite of this RFP. Proposals will be evaluated against the evaluation criteria as follows: Evaluation Criteria Points:__ 1) Company Experience__100 Points Possible 2) Product Sourcing & Quality__400 Points Possible 3) Food Safety & Compliance__300 Points Possible 4) Logistics & Distribution__200 Points Possible Total Points Available via Technical Scoring - 1,000 Points Possible *Offerors must obtain score of 700 points (70%) to move to the final cost evaluation stage. Stage 3: Cost Evaluation The Offeror with the lowest total cost will receive the maximum points of 250. Points assigned to each Offeror's cost proposal will be based on the lowest proposal price. The Offeror with the lowest total cost will receive 250 or 100% of the total cost points. All other Offerors will receive a portion of the total cost points based on what percentage higher their total cost is than the total lowest cost. The formula to compute the points is: Cost Points x (Lowest Proposed Price/Proposed Price). Pursuant to Utah Code Annotated (UCA) § 63G-6a-707(7), the cost proposal will be evaluated independently from the technical proposal, and as such, must be submitted separately from the technical proposal. Offerors must not include costs or pricing data in their responses to the Mandatory Minimum Requirements and the Technical Response. Offerors with a score of less than the minimum required technical points will be deemed non-responsive and ineligible for further consideration. Any proposal that receives 875 total points from the combined technical and cost scores will be awarded a contract. The evaluation score sheet has been attached to this RFP. The attached evaluation score sheet states the relative weight that will be given to each evaluation criteria. Length of Contract: 5 Years. Vendor must guarantee its pricing for 3 Months
