About this opportunity

The Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 12 (VA VISN 12) has issued a Special Notice through the VA Great Lakes Acquisition Center (GLAC) regarding a sole source contract for maintenance and repair of Hill-rom Progressa ICU beds at the Milwaukee VA Medical Center. The contract is intended to be negotiated directly with Baxter Hill-ROM after market research confirmed they are the only Original Equipment Manufacturer (OEM) capable of servicing these specialized medical beds. The procurement will be conducted under Statutory Authority 41 U.S.C. 1901 and Simplified Acquisition Procedures, utilizing NAICS code 811210 for equipment maintenance and repair services. The contract structure will be a firm fixed-price arrangement with a base year and four option years. Market research revealed no alternative vendors capable of meeting the VA's specific technical requirements for maintenance and repair.

Contractors interested in challenging the sole source determination must submit detailed capability statements by 10:00 AM CDT on 04/18/2025 directly to Makena James via email. To be considered, vendors must provide two critical pieces of documentation: a letter from the Original Equipment Manufacturer (OEM) authorizing their work and proof that all technical personnel are OEM certified. While the VA will evaluate any submitted responses, the agency retains sole discretion to proceed with the sole source negotiation with Baxter Hill-ROM. Telephone inquiries are explicitly prohibited, and no solicitation documents are currently available. If no acceptable alternative vendors are identified through this special notice process, the VA will move forward with negotiating the contract with the incumbent vendor. The opportunity is not a competitive solicitation, but rather a notification of intent to award a sole source contract based on unique technical requirements and market research findings.

Notice text

Under Statutory Authority 41 U.S.C. 1901 the VA Great Lakes Acquisition Center (GLAC) intends to negotiate a sole source contract with Baxter Hill-ROM for annual and preventative maintenance, repair, and emergency repair on the Progressa ICU beds at the Milwaukee VA Medical Center. The maintenance and repair of the Progressa ICU beds must be completed by OEM factory trained personnel and also be authorized to work on the equipment they are servicing in order to safely maintain and repair the products for patient use. Market research was conducted, and one OEM factory trained vendor was found. When a quote was received, it could not be deemed as fair and reasonable as it was significantly higher than the IGCE. No other companies were found. Procurement will be issued as a sole source (to the OEM) in accordance with FAR 13.106-1(b).

This acquisition is conducted under the authority of 41 U.S.C. 1901 Simplified Acquisition Procedures as implemented in FAR 13.106-3(b)(3)(i), only one responsible source and no other supplies or services will satisfy agency requirements. This will be a base plus four (4) option years firm fixed price contract. The NAICS Code is 811210.

This Notice of Intent is not a request for competitive quotes. No solicitation documents are available, and telephone requests will not be honored. However, if a firm believes it can meet the requirements it must furnish information about its products and services, as well as references from other customers who are using these products and services to the Contracting Officer by 10:00am CDT on 04/18/2025. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the above requirements. This evidence shall include the following:

1. A letter from the Original Equipment Manufacturer (OEM) stating vendor is authorized.

2. Proof all technical personnel are OEM certified.

Responses received will be evaluated, however; a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, the Contracting Officer will proceed with the sole source negotiation with Canon.

Capability statements shall be submitted by email only as a MS Word or Adobe PDF attachment to Makena James at Makena.James@va.gov. TELEPHONIC INQUIRIES WILL NOT BE ACCEPTED.
