IMPORTANT INFORMATION: This document serves as a running tally of questions received from industry regarding solicitation #W912SV22R0009, and the Government responses. These answers are provided here on a non-attribution basis. Questions received after the stated response date in the solicitation may not be accepted, however, the contracting officer reserves the right to address received after that date if deemed in the best interest of the Government.

Q1: Would you consider extending the proposal due date? Obtaining resumes for such detailed requirements / labor categories typically takes longer than 14 days.

A1: The proposal due date has been extended to 9 September 2022 05:00PM EST.

Q2: Are there current incumbent employees you are attempting to retain?

A2: Nondisplacement of Qualified Workers Under Service Contracts will apply to this contract. The non-displacement clause requires the contractor and its subcontractors to offer qualified employees employed under the predecessor contract a right of first refusal of employment under the successor contract.

Q3: Is the previous contract for this requirement available and/or the cost of the previous contract available?

A3: The previous contract # for the Warrior FIT Program is W912SV-21-C-0003 and the total contract value is $995,500. However, this contract is for different requirements from the previous Warrior FIT Program.

Q4: Would you consider sole sourcing this requirement to a SDVOSB in accordance with FAR 19.1406 "Sole source awards to service-disabled veteran-owned small business concerns."?

A4. No.

Q5: The solicitation states that it's issued under FAR Part 13 procedures. The solicitation and requirements for submission lends itself more to FAR Part 15, not 13. Can you confirm that you are using Part 13 simplified procedures? If so, what part of FAR Part 13 are you using?

A5. The solicitation is issued under a Service-Disabled Veteran-owned Small Business (SDVOSB) set-aside using Simplified Acquisition Procedures IAW Federal Acquisition Regulation (FAR) Part 13 under NAICS code 621399, as stated in the solicitation.

Q6: What is the basis of award?

A6: The basis of award is Best Value. Please refer to FAR 52.212-2 Evaluation – Commercial Items stated in Attachment 3 – Provisions and Clauses.

Q7: Are these positions FTEs? If not, what is the estimated hours that will be required per position? Per the PWS 1.4.1 states three (3) full-time human performance specialists. Is the contractor required to provide replacement staff during absences due to sick leave (required by the contract) and/or PTO (required by the contract.)?

A7: These positions are FTE as outlined in PWS Paragraph 5.0.

Q8: Per the response to the Q&A that the government does require that the Nondisplacement of Qualified Workers Under Service Contracts applies. Why is the government requesting resumes for the positions as the norm and requirement is that the contractor would first offer to the current staff the positions?

A8: The Nondisplacement of Qualified Workers Under Service Contracts applies. The Government wants to ensure potential Offerors have read and understand the requirements in the solicitation. The Government needs to be able to evaluate potential Offerors’ proposals whether current employees do or do not accept an offer of employment as outlined in the Executive Order.

Q9: Per the PWS 1.3 Period of Performance states that the period of performance is for 12 months. Will the government consider a Base plus option years?

A9: No.

Q10: The PWS is a bit confusing. Is the government seeking 3 FTE Human Performance Specialists or per 1.4.8.1; 1.4.8.2; 1.4.8.3 and 1.4.8.4 is the government seeking a total of 6 individuals or does 1.4.8.1; 1.4.8.2; 1.4.8.3 and 1.4.8.4 refer to the qualifications of the 3 FTEs mentioned in 1.4.1 and adding a fourth position to the contract as the Contract Manager?

A10: PWS Paragraph 1.4.8 and subparagraphs define the special qualifications required for the positions as outlined in subparagraphs 1.4.8.1-1.4.8.3. There is no PWS Paragraph 1.4.8.4.

Q11: If the contractor is required to offer current qualified employees in the warrior fit program follow on employment, then how are we to get their resume letter of intent when they are employed by an incumbent contractor? Also, when writing the curriculum there are inherently items of interest that only incumbent personnel would know how to author to meet the expectations of the solicitation. Is there a way to eliminate the need for resumes and a course curriculum?

A11: The Government wants to ensure potential Offerors have read and understand the requirements in the solicitation. The Government needs to be able to evaluate potential Offerors’ proposals whether current employees do or do not accept an offer of employment as outlined in the Executive Order. The evaluation criteria for PWS requirements are outlined in FAR 52.212-2 Evaluation – Commercial Items in Attachment 3 (Provisions and Clauses). The Government will not eliminate parts of the evaluation criteria.
