SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

BASIS OF AWARD

BASIS OF AWARD

A. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factor(s) considered (Lowest Price Technically Acceptable).

In order to be considered awardable, there must be an acceptable rating in every non- price factor. The offeror is responsible for submitting a well-written proposal, with adequately detailed information, which clearly demonstrates compliance with the solicitation requirements.

The U.S. Government intends to evaluate proposals and award a contract without discussions, but reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

Discussions will only be conducted with those in the competitive range.

Offerors may be asked to clarify some issues regarding the technical factors and non price factors to enhance U.S. Government understanding. Such clarifications shall not be used to cure proposal deficiencies or material omissions, and/or otherwise revise the proposal.

Award may be made on the basis of the lowest evaluated price of proposals meeting the acceptability standards for the below factors.

B. FACTORS

The solicitation provides for the following non-price factors: Technical Factor I- Design Past Experience Technical Factor II – Construction Past Experience Factor III – Past Performance Factor IV – Price

C. EVALUATION OF THE NON-PRICE FACTORS

Phase One. The Contract Specialist will screen each proposal for completeness to ensure that all mandatory requirements for this solicitation have been addressed. This level of evaluation does not include an in-depth reading of the proposal’s content, but it is conducted solely to ensure that a complete proposal has been received and that meets the requirements of the solicitation. Failure to address all the mandatory requirements may be grounds to disqualify the proposal from further review.

Phase Two. In this phase, the evaluation team, comprised of experts appointed by the SSA, evaluates the technical factor.

TECHNICAL FACTOR I – DESIGN EXPERIENCE

The offeror shall demonstrate recent and relevant Experience in scope, complexity and price. The Government will evaluate the information concerning three (3) relevant design for projects provided by the offeror on the Attachment #3 entitled “Design Experience Questionnaire. (in English) The technical factor will be rated on an acceptable/unacceptable basis using the following ratings:

Acceptable

To be considered acceptable, the offeror demonstrate relevant design experience for at least three (3) projects which contain any of the following works : structural adaptation, upgrade, modification, of existing building having framed bearing structure. At least one (1) of the projects must be relate essentially to a steel job. It is accepted that one of the projects is for construction instead of modification of the same kind of buildings as described above (but in this case, the value for the structural work will be raised to Euro 200,000)

Thes past design projects must have been performed by the design firm signing the letter of intent as required by Section L of this solicitation.

The past design contracts must have been performed and completed within five (5) years from the date of this solicitation as identified on Page 1, Block 3. The value of each construction project shall be not less than Euro 100,000.

Unacceptable This factor will be considered unacceptable if the offeror fails to demonstrate relevant design experience for at least three (3) projects which contain any of the following works: structural adaptation, upgrade, modification, of existing building having framed bearing structure. This factor will be considered unacceptable if at least 1one (1) of the projects must be relate essentially to a steel job. It is accepted that one of the projects is for construction instead of modification of the same kind of buildings as described above (but in this case, the value for the structural work will be raised to Euro 200,000)

The past contracts were not performed and completed within five (5) years from the date of this solicitation as identified on Page 1, Block 3. The value of each construction project shall be not less than Euro 100,000.

Technical Factor II – CONSTRUCTION EXPERIENCE

The offeror shall demonstrate recent and relevant Experience in scope, complexity and price. The Government will evaluate the information concerning three (3) relevant projects provided by the offeror on the Attachment # 4 entitled “ Construction Experience Questionnaire (in English)”.

The technical factor will be rated on an acceptable/unacceptable basis using the following ratings: ”.

Acceptable To be considered acceptable, the offeror demonstrate relevant construction experience for at least three (3) projects which contain any of the following works: structural adaptation, upgrade, modification, of existing building having framed bearing structure. At least one (1) of the projects must be relate essentially to a steel job. It is accepted that one (1) of the project is for construction instead of modification of the same kind of buildings as described above (but in this case, the value for the structural work will be raised to Euro 200,000).

The three (3) past contracts must have been performed and completed within five (5) years from the date of this solicitation as identified on Page 1, Block 3. The value of each construction project shall be not less than Euro 100,000.

Unacceptable This factor will be considered unacceptable if the offeror fails to demonstrate relevant construction experience for at least three(3) projects which contain any of the following works:

structural adaptation, upgrade, modification, of existing building having framed bearing structure. This factor will be considered unacceptable if at least one (1) of the projects must be relate essentially to a steel job. It is accepted that one of the projects is for construction instead of modification of the same kind of buildings as described above (but in this case, the value for the structural work will be raised to Euro 200,000) .

The three (3) past contracts were not performed and completed within five (5) years from the date of this solicitation as identified on Page 1, Block 3. The value of each construction project shall be not less than Euro 100,000.

Non Price Factor III — PAST PERFORMANCE

This factor will be rated acceptable or unacceptable based on whether the past performance submitted for consideration is relevant and demonstrates successful past performance by the offeror, such as: no terminations for default, no ratings less than satisfactory by its customers/references, whether the quality of its work was satisfactory and completed in a timely manner and whether the offeror demonstrated reasonableness and cooperation during performance of the contracts. Past failure to apply sufficient tenacity and perseverance to perform acceptably is strong evidence of unacceptable past performance. In addition, failure to meet the quality requirements of a contract is a significant factor to consider in determining unsatisfactory performance. Offerors may be asked to clarify some issues regarding the aforementioned factors to enhance U.S. Government understanding. Such clarifications shall not be used to cure proposal deficiencies or material omissions, and/or otherwise revise the proposal.

Past Performance Evaluation Ratings

Rating Descriptions:

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a) (2) (IV).

Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability “unknown” shall be considered “acceptable”.

For Past Performance to be considered relevant, the offeror shall submit information about two projects which contain any of the following works : structural adaptation, upgrade, modification, of existing building having framed bearing structure. At least one (1) of the projects must be related to a job where the steel construction is prevailing.

The magnitude must be not less than Euro 100,000 per individual project. To be considered recent, the project must be completed in the last five years from the date of this solicitation (date shows at Block no.

3 of SF 1442).

The offeror is encourage to submit past performance information with evidence of customer satisfaction such as performance evaluation, special commendation, recognition, letters of appreciation, “certificato di regolare esecuzione” o “collaudo finale” photographs of the projects, etc.

The Past Performance is considered to be not relevant if it is not similar in work i.e. projects which contain any of the following works : structural adaptation, upgrade, modification, of existing building having framed bearing structure.

At t least one (1) of the projects is not related to a job where the steel construction is prevailing. The magnitude is less than Euro 100,000 per individual project.

It will be considered not recent if it is not completed in the last five (5) years from the date of this solicitation (date shows at Block no. 3 of SF 1442).

The Government will conduct a past performance assessment on all contracts, at least three (3), submitted by the offeror on the Past Performance Questionnaire (Attachment #5). The Government will consider the recency and relevance of the information, source of the information, context of the data, and general trends in contractor’s performance.

The Government will consider the Past Performance Questionnaire information, as well as information obtained from any other sources.

Factor IV - EVALUATION OF THE PRICE

A contract will be awarded to the Lowest Priced Technically Acceptable Offeror (LPTA). The total price indicated at CLIN 0001 will be evaluated for fair and reasonableness and for unbalanced pricing.

Unrealistic, unbalanced or unreasonable pricing may cause a proposal to be determined unacceptable.

Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques.

A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

The purpose of this amendment is as follow:

a) to provide all prospective contractor with a copy of "Piano di Sicurezza e Coordinamento Preliminare", "Allegato 01 Schede Valutazione dei rischi" and "Allegato 02 Costi della Sicurezza".

b) to revise Section J to include:

- Attachment #9 "Piano di Sicurezza e Coordinamento Preliminare" consisting of 34 pages dated 13 May 2016 (Review 01);

- Attachment #10 "Allegato 01 Schede Valutazione dei rischi" consisting of 93 pages dated 02 May 2016 (Rev 00), and

- Attachment #11 "Allegato 02 Costi della sicurezza" consisting of 2 pages dated 02 May 2016 (Rev 00).

c) to change the amount indicated in FAR clause 52.211-12 "Liquidated Damages -- Construction (Sep 2000)" from EURO 175.50 to EURO 175.00.

d) to change the "Basis of Award", the paragraph immediately after "Technical Factor I - Design Experience", from "concerning two (2) relevant design for projects" to "concerning three (3) relevant design for projects", and

e) to correct the "Basis of Award, the paragraph immediately after "Technical Factor II - Construction Experience", from "concerning two (2) relevant projects" to "concerning three (3) relevant projects.
