SECTION SF 30 BLOCK 14 CONTINUATION PAGE

SUMMARY OF CHANGES

Q. Regarding Davis-Bacon wages – what classification should the well drillers and their helpers use? I don’t see anything listed on the GENERAL DECISION: ID20100002 06/10/2011 ID2 that would be applicable for a well driller or their helper.

A. Based on surrounding States the Driller is considered in the Power Equipment Operator category. See attached General Decision ID100011 HEAVY for power equipment operator rates.

Q. We also need to know what classification the pump installers would use – would that be pipefitters?

A. Yes

Q. For purposes of leveling the field could you provide which labor rate that the landscaping and irrigation work will fall under? There is not a clear determination.

A. Laborer/General Cleanup

NOTE: See revised Building Wage Decision dated 24 June 2011.

In Specification Section 263100 - Photovoltaic Collectors, paragraph 2.3.A – Basis of Design: The Government does not require SunPower photovoltaic modules, but alternate, approved modules must be similar in construction, size, rating, and weight to provide for the designed performance of the system and the same physical layout of the systems. Structural considerations must be equivalent based on the structural design of the buildings. Note that the specification indicates that prior approvals will only be reviewed during the bidding process. Due to the 315W panels being discontinued, it is acceptable to use the 320W panels. Based on power production deviation, it is acceptable to reconfigure the PV arrays and modify the quantity of panels in order to maintain the same system size as that specified. Revised quantities of panels will be evaluated during shop drawings for conformance with the design intent.

In Specification Section 263100 - Photovoltaic Collectors, paragraph 2.3.A – Basis of Design:

Refer to sheet E-600 – One Line Diagram for configuration of basis of design inverters for both buildings.

This paragraph is for coordination purposes that require the PV installer to coordinate with the installed lightning protection system and lightning protection system installer to assure a complete, acceptable system.

In Specification Section 263100 - Photovoltaic Collectors, paragraph 3.10.A : The following testing procedure will be acceptable in lieu of a complete system test prior to shipment: As part of the commissioning procedure, each module’s short circuit current and open circuit voltage will be tested and logged immediately prior to installation. This test log will become part of the installer’s O&M Manual which is submitted to the Government.

In Specification Section 263100 - Photovoltaic Collectors, paragraph 3.10.B: It will be acceptable if the installer’s qualifications support their position as a “factory authorized service representative” with the manufacturer as authorized.

In Specification Section 263100 - Photovoltaic Collectors, paragraphs 3.11.A – Demonstration and Training and 3.12.A –Service Agreement: The agreements listed are requirements of the construction contract and are to be included in the cost of the construction project regardless of the affiliation/contractual relationship with the Government. The construction contract will enforce that these requirements are met, not a separate agreement between the Government and Installer

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour

Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the

Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the

Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations

(See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative

Review Board (formerly the Wage Appeals Board). Write to:
